Any owner of a parcel benefitted by the easements <br />created by this Section VIII shall have the right, in the event <br />any owner fails to maintain or repair their respective portion <br />of the drainage ditch, to effect such maintenance or repair, <br />and shall be entitled to be reimbursed for the cost of such <br />maintenance or repair by the owner failing to so maintain or <br />repair the drainage ditch. <br />IX. Obligations of the Owner of Parcel 3. <br />The obligation of the Owner of Parcel 3 to payor reimburse <br />the Owner of Parcel 1 for the costs and expenses incurred by <br />the Owner of Parcel 1 in connection with the water line exten- <br />sion referred to in Section IV hereof, the fire protection sys- <br />tem referred to in Section V hereof and the septic tanks and <br />related sewer lines referred to in Section VII hereof shall be <br />of no force and effect until such time as the Owner of Parcel 3 <br />com-mences the construction of improvements on Parcel 3. At <br />the time such construction commences and to the extent the <br />Owner of Parcell has incurred any expenditures, the Owner of <br />Parcel 3 shall pay to Owner of Parcel 1 all amounts due to the <br />owner of Parcel 1 pursuant to Sections IV and VII of this <br />Declaration. Thereafter, the Owner of Parcel 3 shall make all <br />payments due the Owner of Parcel 1, as provided herein. <br />X. Obligations of the Owner of Parcel 1. <br />The obligation of the Owner of Parcell to pay or'~eimburse <br />the Owner of Parcel 3 for the costs and expenses incurred by <br />the Owner of Parcel 3 in connection with the road construction <br />referred to in Section I hereof and the Railroad Improvments <br />referred to in Section II hereof shall be of no force and <br />effect until such time as the Owner of Parcel 1 commences the <br />construction of improvements on Parcell. At the time such <br />construction commences, and to the extent the Owner of Parcel 3 <br />has incurred any expenditures, the Owner of Parcel 1 shall pay <br />to the Owner of Parcel 3 all amounts due to the Owner of Parcel <br /> <br />-14- <br />
