Any owner of a parcel benefitted by the easements created by this Section VIII shall have the right, in the event any owner fails to maintain or repair their respective portion of the drainage ditch, to effect such maintenance or repair, and shall be entitled to be reimbursed for the cost of such maintenance or repair by the owner failing to so maintain or repair the drainage ditch. IX. Obligations of the Owner of Parcel 3. The obligation of the Owner of Parcel 3 to payor reimburse the Owner of Parcel 1 for the costs and expenses incurred by the Owner of Parcel 1 in connection with the water line exten- sion referred to in Section IV hereof, the fire protection sys- tem referred to in Section V hereof and the septic tanks and related sewer lines referred to in Section VII hereof shall be of no force and effect until such time as the Owner of Parcel 3 com-mences the construction of improvements on Parcel 3. At the time such construction commences and to the extent the Owner of Parcell has incurred any expenditures, the Owner of Parcel 3 shall pay to Owner of Parcel 1 all amounts due to the owner of Parcel 1 pursuant to Sections IV and VII of this Declaration. Thereafter, the Owner of Parcel 3 shall make all payments due the Owner of Parcel 1, as provided herein. X. Obligations of the Owner of Parcel 1. The obligation of the Owner of Parcell to pay or'~eimburse the Owner of Parcel 3 for the costs and expenses incurred by the Owner of Parcel 3 in connection with the road construction referred to in Section I hereof and the Railroad Improvments referred to in Section II hereof shall be of no force and effect until such time as the Owner of Parcel 1 commences the construction of improvements on Parcell. At the time such construction commences, and to the extent the Owner of Parcel 3 has incurred any expenditures, the Owner of Parcel 1 shall pay to the Owner of Parcel 3 all amounts due to the Owner of Parcel -14-
