Being a 10.00 feet wide utility easement across the East portion of a 2.000 acre tract and a 0.517 acre tract of land that are part of a 159.504 acre tract of land, designated as Tract 1 on a plat of various tracts near Fairmont Park Subdivision as surveyed by Shaner, Hicks and Cherry, dated October and November 1973~ located in the W. M. Jones Survey, A-482, La Porte, Harris County, Texas; said 0.517 acre tract of land was conveyed to Kinder-Care Learning Centers, Inc. by Eddie V. Gray, Trustee and G. Decker HcKim, Trustee, on September 15. 1982. as evidenced by the instrument recorded under Harris County Clerk's File Number H 630596. The 10.00 feet wide utility easement is more particularly described as follows; Beginning at a 5/8 inch iron rod found for the Southeast corner of Lot 1. Block 5, Creekmont Subdivision, S~ction One according to the plat recorded in Volume 279, Page 145 of the Harris County Map Records. Thence, following a curve to the right in a Southwesterly direction; coincident with the West right-of-way line of Myrtle Creek Drive (based on a right-of-way width of 60.00 feet) according to the plat recorded in Volume 284, Page 100 of the Harris County Map Records; said curve having a radius of 770.00 feet and a central angle of 80 53' 23"; for an arc distance of 119.47 feet to a 5/8 inch iron rod found for the point of tangency. Thence, S 310 10', W; coincident with the West right-of-way line of Myrtle Creek Drive; passing at 55~67 feet a 5/8 inch iron rod found for the Southeast corner of the 2.000 acre tract and the Northeast corner of the 0.517 acre tract, for a total distance of 100.00 feet to a 5/8 inch iron rod found for a point of .' curve. Thence, following a curve to the left in a Southwesterly direction; coincident with the West right-of-way line of Myrtle Creek Drive; said curve having a central .' angle of 30 52' 54" and a radius of 1,050.00 feet; for an arc distance of 71.14 feet to a 1/2 inch iron rod set for the Southeast corner of the 0.517 acre tract and Southeast corner of this 10.00 feet wide utility easement. Thence, West; coincident with the South boundary line of the 0.517 acre tract; a distance of 11.24 feet to a point for the Southwest corner of this easement. Thence, following a curve to the right in a Northeasterly direction; said curve having a central angle of 40 09' 37" and a radius of 1060.00 feet; for an arc distance of 76.97 feet to a point of tangent. Thence, N 310 10' E; passing at 38.28 feet the North boundary line of the 0.517 acre tract and the South boundary line of the 2.000 acre tract; for a total distance of 100.00 feet to a point of curve. Thence, following a curve to the left in a Northeasterly direction; said curve having a central angle of 80 34' 50" and a radius of 760.00 feet; for an arc distance of 113.82 feet to a point for the Northwest corner of this easement. Thence.
