i + - - AMENDMENT OF EASEMENT THE STATE OF TEXAS X COUNTY OF HARRIS X WHEREAS, by instrument dated November 23, 1987, EXXON PIPELINE COMPANY (hereinafter called "Grantor") executed and delivered to the CITY OF LA PORTE, TEXAS (hereinafter called "Grantee") a Pipeline Easement (herein called "Easement") whereby Grantor granted and conveyed unto Grantee the right to construct, maintain, operate, repair, replace, and remove an eight-inch (8") pipeline for the transportation of water, said right of way and easement being more particularly identified and described in Exhibit "A" attached thereto and made a part thereof. WHEREAS it is the desire of Grantee and Grantor to amend the Easement, for the purpose of redefining the metes and bounds description of the existing 8" water line and authorizing Grantee to relocate the pipeline within the redefined metes and bounds description. NOW, THEREFORE, for and in consideration of the sum of Ten Dollars ($10.00) and other good and valuable consideration, the receipt of which is hereby acknowledged, Grantor and Grantee agree to amend the Easement only insofar as Exhibit "A" attached hereto is substituted for the existing Exhibit "A" attached to the Easement. IT IS AGREED by the parties hereto that nothing contained herein shall be construed as altering, amending, or affecting the Easement or any of its terms and provisions, but all of the terms and provisions of the Easement shall apply to and be construed with the hereby metes and bounds description of the Easement in the same manner as if the Easement had been originally written as hereby amended. The provisions hereof shall extend to, be binding upon, and inure to the benefit of the parties hereto, their respective heirs, successors, and assigns. .., ~ EXECUTED this the ~~ day of , 19~, the parties hereto acting by and through the duly authorized ice of each.
