<br />Notwithstanding anything to the contrary contained herein, GRANTEE's
<br />rights hereinunder shall extend to only so much of the premises as are owned
<br />by GRANTOR on the date hereof. In addition, GRANTEE's rights shall be
<br />specifically under and subject to the rights of any other parties holding
<br />easements, rights-of-way, or similar interests in and to the above-described
<br />premises and whether by recorded instrument or apparent by visual inspection
<br />including specifically, but not limited to the Tennessee Gas Transmission
<br />Company's 75 foot wide right of way as described in that certain easement,
<br />dated June 19, 1957, and recorded in Vol. 3410, Page 320, Deed Records of
<br />Harris County, Texas.
<br />
<br />GRANTEE, in its use of the premises, from and after the date hereof,
<br />does hereby agree that it shall release, discharge, indemnify, claims, causes
<br />of action, suits, judgements, costs, or expenses for property damage or
<br />personal injury, including death, and founded upon GRANTEE's exercise of any
<br />rights or privileges or the conduct of any activities by GRANTEE on GRANTOR's
<br />lands under or by virtue of this Agreement. Such indemnity shall not extend
<br />to liability for any such property damage or personal injury, including death,
<br />to the extent that GRANTOR, its successors or assigns, are solely negligent in
<br />causing such damage or injury.
