Box 1115 <br />La Porte, TX 77572-1115 <br /> <br />] 51 =70=0374 <br /> <br />In addition to the easement, and <br /> <br />the rights <br /> <br />and privileges <br /> <br />herein conveyed, Grantee shall have,the right to use so much of <br /> <br />the surface of the Subject Property as may be reasonably <br /> <br />necessary to construct, place, replace, operate, repair, enlarge, <br /> <br />maintain and install the <br /> <br />facilities contemplated <br /> <br />by this <br /> <br />instrument. <br /> <br />Upon the completion of such construction and <br /> <br />installation, Grantee shall be obligated to restore the surface <br /> <br />and all <br /> <br />improvements affected by the construction to the <br /> <br />condition it was in prior'to Grantee's construction, placement, <br /> <br />replacement, <br /> <br />repair, <br /> <br />enlargement <br /> <br />or <br /> <br />maintenance <br /> <br />of its <br /> <br />facilities. <br /> <br />The easement rights and privileges granted herein shall <br /> <br />expire at such time as Grantee, its successors or assigns ceases <br /> <br />to operate the waterline easement discussed herein. <br /> <br />Grantor hereby binds itself, its legal representatives, <br /> <br />successors and assigns to warrant and forever defend the above <br /> <br />described easement and rights unto Grantee, its successors and <br /> <br />assigns, against every person whomsoever lawfully claiming or to <br /> <br />claim the same or any part thereof by, through, or under Grantor, <br /> <br />but not otherwise. <br /> <br />The easement, rights and privileges granted herein are not <br /> <br />exclusive and grantor reserves and retains the right to convey <br /> <br />similar rights and easements to such other persons or entities as <br /> <br />Grantor may deem proper <br /> <br />provided however, <br /> <br />that any such <br /> <br />conveyance does not interfere with the use of the Subject <br /> <br />Property by Grantee. <br /> <br />Should Grantee fail to install a waterline within the <br /> <br />easement rights and privileges granted herein on or before <br />January 1, 1990, then all rights and privileges granted hereby <br /> <br />shall terminate and this easement shall be of no further force <br /> <br />and effect. <br /> <br />Grantor expressly <br /> <br />reserves <br /> <br />unto <br /> <br />Grantor, <br /> <br />its legal <br /> <br />representatives, successors and assigns, the right to use and <br /> <br />enjoy the surface and subsurface of the Subject Property for any <br />and all purposes which do not interfere with the use thereof by <br /> <br />Grantee for the herein specified purposes, and reserves unto <br />
