<br />1. That HOUSTON ASSOCIATES, a California general partnership, doing

<br />business in Harris County, Texas, under the assumed business name of

<br />HOUSTON ASSOCIATES-CALIFORNIA GENERAL PARTNERSHIP, hereinafter called
<br />
<br />Grantor, for a good and va~uable consideration, to be paid by the CITY

<br />OF LA PORTE, hereinafter called Grantee, does hereby grant, sell, and

<br />convey unto Grantee an easement and right-of-way upon and across the
<br />
<br />following described property of Grantor:

<br />and out of Lots 29, 28, 27, 26, and 25, Strang s~bdivision
<br />per map or plat of said Subdivision recorded in Volume 75,
<br />Page 22 of the Deed Records ot Harris County, Texas, said
<br />28.2125 acre 'tract of land being more particularly described
<br />~y metes and bounds set forth in the attached exhibit dated
<br />February 15, 1991, prepared by Don Denson, Registered Professional
<br />Land Surveyor No. 2068, State of Texas, entitled "Field Note
<br />Description", marked Exhibit A and made a part hereof as,if
<br />set forth herein verbatim.

<br />2. ,The easement and right of way hereby conveyed shall be upon and

<br />across and limited to the following described portion of the above

<br />That one certain ten (10) foot strip of land lying over and across
<br />the above described property said (lO), foot strip of land being
<br />more particularly described by metes and bounds as set forth in the
<br />attached field note description date November 24,1992 prepared by Don
<br />Denson,Registered Professional Land Surveyor No. 2068, State of
<br />Texas,entitled "WATER LINE EASEMENT", marked Exhibit B and made a
<br />part hereof as if set forth herein verbatim.

<br />3. The right-of-way, easement, rights, and privileges herein
<br />
<br />granted shall be used only for the purpose of placing, constructing,
<br />
<br />operating" repairing, maintaining, rebuilding, replacing, relocating
<br />
<br />and removing one underground water line eight inches in diameter.
