WIT N E SSE T H (1) All references to "Utili ty Ma in (s) II hereunder shall, for the purposes of thi s agreement, refer to the following: (a) "nearest existing utility main(s)" as referred to herein shall consist of the utility mains located or to be ------.---- located within that one certain utility easement ten (10) feet in width as set forth and defined in instrument filed for record under Clerk's File No. N082830 in the Official Public Records of Real Property of Harris County, Texas and (b) "extension of its utility main(s)" as referred to herein shall consist of one (1) underground water line eight inches in diameter, said water line to be located within the area described in metes and bounds in attached Exhibit "B" entitled "WATER LINE EASEMENT" . (2) Owner is the owner of certain property in the City of La Porte, Ha rri s County, T exa s, i dent i fi ed as; Follows: That one certain 28.2125 acre tract of land being part of and out of Lots 29, 28, 27, 26, and 25 of the Strang Subdivision and addition in Harris County Texas said 28.2125 acre tract being described in metes and bounds in attached Exhibit "A" City's utility mains do not presently extend to said property. Owner has requested City to extend utility mains to Owner's said property.
