<br />That we, HOOVER COCHRAN and wife, HELEN LOUISE COCHRAN, of
<br />Harris County, Texas, hereinafter called Grantor' (whether one or
<br />more), for and in consideration of the sum of Ten and No/IOO Dollars
<br />($10.00) cash and other' good and valuable considerations - to me in I
<br />hand paid by the CITY OF LA PORTE, a municipal corporation of Harris I~
<br />County, Texas, whose mailing address is P.O. Box l115, La Porte,
<br />Texas 77572-l115, hereinafter called Grantee, receipt of which is
<br />hereby acknowledged and confessed, have GRANTED, SOLD and CONVEYED,
<br />and by these presents do GRANT, SELL and CONVEY unto the said
<br />Grantee, the following described property, for right-of-way for
<br />Buchanan Street, a public street in the City of La Porte, Harris
<br />County, Texas, to-wit:

<br />Being a 20 feet wide roadway and utility easement across the
<br />West 20 feet of that certain tract conveyed to Hoover and Helen
<br />Cochran by M.H. and Nettie Buchanan, on March 9, 1962 (Vol.
<br />4667, Pg. 75, H.C.D.R.), comprising part of Outlot 473, La
<br />Porte Out lots (Vol. 61, Pg. 374, H.C.D.R.), Enoch Brinson
<br />Survey, A-5, La Porte, Harris County, Texas. The 20 feet wide
<br />utility easement as surveyed by H. Carlos Smith Engineers and
<br />Surveyors, Inc. on August 26, ~1~9l, is more particularly
<br />described by metes and bounds on Exhibit "A" attached hereto,
<br />incorporated by reference herein, and made a part hereof for
<br />all purposes.

<br />TO HAVE AND TO HOLD the above described premises, together with
<br />all and singular, the rights and appurtenances thereto in any wise
<br />belonging unto the said City of La Porte, its successors and
<br />assigns, save and except the following reservations and provisions:

<br />The Grantor reserves all of the oil, gas and sulphur in and
<br />under said land, but waives all rights of ingress and egress for the
<br />purpose of exploring, developing, mining or drilling for the same~
<br />however, nothing in this reservation shall effect the rights of the
<br />City of La Porte to use said land and other minerals and materials
<br />thereon, therein or thereunder ,for road purposes, it being
<br />specifically understood that the City of La Porte and its assigns
<br />shall be vested with the title to and the right to take and use,
<br />without additional compensation, any stone, earth, gravel, caliche
<br />or any other materials or minerals upon, in and under said land,
<br />except oil, gas and sulphur, for the construction and maintenance of
<br />Buchanan Street.

<br />And the Grantor herein does hereby bind himself, his heirs,
<br />executors and administrators, to warrant and forever defend, all and

<br />assigns against every person whomsoever lawfully claiming or to
<br />claim the same or any part thereof.
