J. Payne Subdivision, a subdivision <br />according to the map thereof recorded in Volume 384, Page 161 of the <br />Harris County Deed Records, in the William M. Jones League, Abstra~t <br />482, Harris County, Texas, said lots b~ing part of 300.0 Acre's <br />conveyed to the City of LaPorte by Quitclaim Deed recorded in Vo1~e <br />1614, Page 190 of the Harris County Deed Records. <br /> <br />y <br /> <br />It is distinctly understood that this agreement does not constitute a <br />conveyance of the land above described, nor of the minerals therein and <br />thereunder, but grants only a right-of-way and easement subject to the <br />following: <br /> <br />(a) The easement granted herein is solely for the purpose of permitting <br />GRANTEE to construct, operate, place, lay, inspect, protect, alter, substitute, <br />repair, relocate, maintgin, replace;' and remove ~uch undergroundte1ecommunica- <br />tions facilities, and necessary above ground appurtenances thereto, as GRANTEE, <br />its successors and assigns, may from time to time require upon, over, above, <br />under, and across The Property; the right of pedestrian and vehicular ingress <br />to and egress from said easement via reasonable routes across The Property; the <br />right to clear and keep cleared trees, brush, and all other obstructions from <br />the surface and subsurface of said easement, subject to the exceptions stated <br />herein; and, the right to install, maintain, and use gates in fences which cross <br />said easement. <br /> <br />(b) The easement granted herein shall be ten (10) feet in width, being <br />five (5) feet on either side of the centerline of all telecommunications <br />facilities installed by GRANTEE, it being understood that the location of said <br />facilities shall be mutua11y,agreed upon between the parties hereto, or ~heir <br />successors, successors in interest, and assigns, prior to the commencement of <br />facilities construction activities by GRANTEE within The Property. This <br />easement's centerline, commencing near the intersection of Buchanan Street with <br />the North line of the Property and terminating at a FAA Radio Transmitter <br />Facility within The Property, is located NorthjWest of and parallel' to an <br />electric distribution facilities easement conveyed by GRANTOR herein to Houston <br />Lighting & Power Company on July 29, 1992. <br /> <br />- '- (c) GRANTOR, ~ its succes,sors and assigns, shall-have the right to <br />cultivate and otherwise use the surface and subsurface of the easement herein <br />granted insofar as such use does-Ro,t:-inter-fer.e..w,i..th__or_ ohs.tr.uc_t_ the u~e of the <br />easement by GRANTEE, or its successors and assigns. <br />.
