Grantor herein retains for itself, its successors and assigns, the right to fully use and enjoy said premises, except as the same may be necessary for the purposes herein granted. 2. Grantee hereby binds itself. its successors, assigns, agents. and licensees to indemnify and hold harmless Grantor from and against any and all claims. actions. causes of action, demands, liabilities. costs, losses, expenses. and damages, in contract, strict liability, or in tort, for injury to any person (including death) or damage to any property arising out of or in any way connected with the construc- tion, use and existence of said pipeline on Grantor's property, where such injury or damage is caused by the sole, joint, concurrent, contributing or comparative negligence or fault of Grantee. its agents, or employees, and even when caused by the joint, concurrent, contributing or comparative negligence or fault of Grantor, its agents or employees. This indemnity shall not be applicable where the injury or damage is caused by the sole negligence of the Grantor. its agents or employees. 3. Grantee, its successors and assigns. assumes all costs resulting from any temporary or permanent alterations to or changes in the structure support arrangement or installation (including, but not limited to, temporary guying, strengthening of structures and addi- tional ground line treating of poles due to the disturbing of the earth around the base of poles) of any of Grantor's structures or improvements located near the easement herein granted and made neces- sary by the construction, maintenance, operation. and removal of said pipeline or any use consistent with the purposes of this easement by Grantee, its successors or assigns. 4. Grantee, its successors and assigns, will conduct the installa- tion, maintenance, operation, repair and removal of said pipeline in such a manner as to limit the extent of damage to the surface of Grantor's land to a minimum. 5. Grantee, its successors and assigns. will obtain from Grantor, its successors and assigns, specific approval of each item of accessory equipment to be associated with, or installed on. said pipeline prior to such actual association or installation of said equipment. which approval shall not be unreasonably withheld. 6. In the event that Grantee, its successors and "assigns, shall abandon such right-of-way, this grant shall immediately terminate and all rights hereunder shall there-upon revert to Houston Lighting & Power Company, its successors and assigns. and Grantee shall further.
