PLANT PROPERTIES AND IUGHT-OF-VAYS As a prerequisite to pipeline installation on Houston Lighting & Power Company's fee property or easements, hereinafter called Right-of-Way, Grantee, its successors and assigns, shall agree to and be responsible that its contrac- tor and/or subcontractors abide by the following construction requirements: 1. Grantee, its successors and assigns, is responsible for notify- ing all parties having an-interest-in or an-easement-on, under, or above the Right-of-Way. The construction requirements of these concerned parties with prior rights shall be observed; however, Houston Lighting & Power Company's construction requirements shall be adhered to as a minimum. 2. Houston Lighting & Power Company's Transmission Engineering Division (713-228-9211) shall be notified seven (7) days prior to beginning ANY TYPE of work so that inspection may be arranged. Grantee shall give the name and telephone number of its representa- tive, or inspector responsible for the pipeline installation, to insure that a preliminary and final inspection of Houston Lighting & Power Company's structures and Right-of-Way will be performed. The repair of damages to Houston Lighting & Power Company's facilities, caused by the Grantee's contractor, shall be paid by Grantee. No work for initial installation shall be performed on Saturdays, Sundays, or Holidays on Houston Lighting & Power Company's Right-of-Way unless approved by Houston Lighting & Power Company. 3. ~rantee's representative, agent, or inspector shall have a copy of the signed agreement or letter of authority to construct pipelines on Houston Lighting & Power Company's Right-of-Way at the construction site whenever ANY TYPE of work is being performed on the Right-of-Way. 4. Any violation of the requirements contained herein shall be considered as grounds, by Houston Lighting & Power Company's inspec- tor, to cause construction to cease until corrective actions are taken. If the contractor fails or refuses to modify his procedures in an acceptable manner, the attached easement may be declared null' and void upon written notification by Houston Lighting & Power Company to Grantee. 5.
