<br />e <br /> <br />. <br /> <br />UTILITY EXTENSION AGREEMENT <br />(Owner Funded Extension) <br /> <br />THE STATE OF TEXAS: <br /> <br />COUNTY OF HARRIS: <br /> <br />This agreement, made this 1st day of August . 19 97 . by and between the <br /> <br />City of La Porte, herein called "City", acting herein through its Ass i stant Ci ty Manager <br />(Title of Authorized Official) <br /> <br />and B & G Food Enterprises of Texas, LLC <br />{Strike out inapplicable terms} <br />(a corporation), (*'DttD8'sIIi'~"'(i1tMiWtd&a! doing business as Taco Bell Restaurant) <br /> <br />of <br /> <br />Morgan Ci ty . County of <br /> <br />St. Mary <br /> <br />. and State of <br /> <br />Louisiana <br /> <br />hereinafter called "Owner". <br /> <br />WITNESSETH <br /> <br />(1) All references to "Utility Main(s)" hereunder shall, for the pwposes of this agreement, refer to <br />a new sewer line along Fairmont Parkway from 14th Street to the west <br /> <br />side of Block 898, Lot No. 14. <br /> <br />(2) Owner is the owner of certain property in the City of La Porte, Hams County, Texas, identified as; <br />1502 Fairmont Parkway; Lots 17-25, Block 898; Town of La Porte. <br /> <br />Adequate City utility mains do not presently extend to said property. Owner has requested the extension of City <br /> <br />utility main(s) to Owner's said property. <br /> <br />(3) City hereby agrees to the construction and installation of an extension of its utility main(s) to said <br /> <br />property commencing at the nearest existing utility main(s) of sufficient size and capacity. Thence alonglthru City <br /> <br />of La Porte rights-of-way and/or easements to said Owner's property. In the event that necessary rights-of-way <br /> <br />and/or easements do not e.'<ist to facilitate the extension of said utility main(s), Owner shall be solely responsible for <br /> <br />obtaining said additional rights-of-way and/or easements for e.uension of utility main(s) at no cost to City, on City <br /> <br />approved fonDS. <br />
