UTILITY EXTENSION AGREEMENT (Owner Funded Extension) THE STATE OF TEXAS: COUNTY OF HARRIS: This agreement, made this 1st day of August . 19 97 . by and between the City of La Porte, herein called "City", acting herein through its Ass i stant Ci ty Manager (Title of Authorized Official) and B & G Food Enterprises of Texas, LLC {Strike out inapplicable terms} (a corporation), (*'DttD8'sIIi'~"'(i1tMiWtd&a! doing business as Taco Bell Restaurant) of Morgan Ci ty . County of St. Mary . and State of Louisiana hereinafter called "Owner". WITNESSETH (1) All references to "Utility Main(s)" hereunder shall, for the pwposes of this agreement, refer to a new sewer line along Fairmont Parkway from 14th Street to the west side of Block 898, Lot No. 14. (2) Owner is the owner of certain property in the City of La Porte, Hams County, Texas, identified as; 1502 Fairmont Parkway; Lots 17-25, Block 898; Town of La Porte. Adequate City utility mains do not presently extend to said property. Owner has requested the extension of City utility main(s) to Owner's said property. (3) City hereby agrees to the construction and installation of an extension of its utility main(s) to said property commencing at the nearest existing utility main(s) of sufficient size and capacity. Thence alonglthru City of La Porte rights-of-way and/or easements to said Owner's property. In the event that necessary rights-of-way and/or easements do not e.'<ist to facilitate the extension of said utility main(s), Owner shall be solely responsible for obtaining said additional rights-of-way and/or easements for e.uension of utility main(s) at no cost to City, on City approved fonDS.
