<br />That I, Eddie V. Gray, Trustee, ("Grantor"), for and in consideration ofTen Dollars

<br />("Grantee"), a Mlmicipal COll:)Qration, the receipt and sufficiency of which is hereby
<br />acknowledged and confessed, have this day GRANTED, BARGAINED, SOLD AND
<br />CONVEYED and by these presents do GRANT, SELL AND CONVEY unto said Grantee,
<br />and to its successors and assigns, and to its duly franchised public utilities, the perpetual
<br />right, privilege and easement, with appropriate tights of ingress and reasonable working area
<br />for constlUction and maintenance, to enter upon and construct, reconstruct, maintain,
<br />operate, inspect, replacb, repair and remove public utility facilities, owned by Grantee, and
<br />by Grantee's duly franchised public utilities, together with all appwtenances thereto, over,
<br />across, through and under that certain tract or parcel ofland lying and being situated in
<br />Han;s County, Texa.~, and being a 14 foot public utility easement lying 7 feet on either side
<br />ofthe N01th propetty line of the 0.792 acre tract dcscnbed on the sUtvey and being more
<br />patticularly d.escnbed by the metes and bounds description attached hereto as "Exlnbit A"
<br />and made a part hereof for all purposes.

<br />TO HAVE AND TO HOLD the above described easement, together with all and
<br />singulat. the rights and appurtenances thereto in anywise belonging unto said Grantee. and its
<br />successors and assigns, and its duly franchised public utilities, in accordance with the terms
<br />and conditions het'einabove set forth, the Grantor does hereby bind theImelves, their heirs or
<br />assigns to W ARRA]\rr AND FOREV ER DEFEND, all and singular the said easement unto
<br />the Grantee, its successors or assigns, against every person whomsoever lawfully claiming
