<br />ATTACHMENTA: CONTROL PAGE <br />COASTAL EASEMENT CE20050145 <br /> <br />GRANTEE'S NAME <br />City of La Porte <br /> <br />PREMISES <br />A portion of State Tract Number 123, Galveston Bay, Chambers County, Texas (the "Premises"). <br />The Premises are further described and depicted on Attachment B attached hereto and <br />incorporated herein by reference. <br /> <br />USE(S) OF PREMISES <br />Authorized Use(s) of the Premises: A 5' x 461' concrete riprap breakwater compnsmg an <br />encumbrance of 2,305 square feet; also, a 20' x 420' band of no-fee rip rap comprising an <br />encumbrance of 8,400 square feet for a total project encumbrance of 10,705 square feet of <br />coastal public land. <br /> <br />ADJACENT PROPERTY <br />Tracts 3, 3A, 4 thru 8, 9A, 9B, 10, 11 & 14, W.B. Lowrence, Abstract 35, Johnson Hunter <br />Survey, as recorded in the real property records of Chambers County, Texas. <br /> <br />.,,,", .... <br /> <br />SPECIAL CONDITIONS <br />1. Riprap breakwaters shall be constructed of suitable limestone rock or broken concrete <br />material that is free of metal rebar. <br />2. Breakwaters shall be built of sufficient height above the substrate to be visible above the <br />water surface at mean high tide. Permanent markers/pilings shall be installed to U.S. <br />Coast Guard specifications. <br />3. Breakwaters shall be designed to allow for the ingress and egress of fish and for water <br />circulation. <br />4. Any accretion of sediment resulting from the transplant project, as determined by the <br />GLO, will be considered property of the State of Texas. <br />5. All derelict structures "located bayward of the approximate boundary between State and <br />private land are to be removed by Grantee within 90 days of the executed contract date. <br />Grantee shall notify the General Land Office in writing within two (2) weeks following <br />completion of the removal effort. <br />6. Impacts to emergent marsh, and/or oyster reefs are to be strictly avoided. <br /> <br />COST OF DAMAGE <br />One Thousand and No/lOO Dollars ($1,000) per event. <br /> <br />EFFECTIVE AND TERMINATION DATES <br />This Agreement is for a total period of five (5) years, effective on February 1,2010, and <br />terminating on January 31, 2015. <br /> <br />P A YMENT(S) AND/OR FEE(S) <br />Grantee and Grantor acknowledge that no rental fees shall be assessed for the described use of <br />the premises, while Grantee is not in default of the terms agreed upon herein. Grantor further <br />acknowledges the receipt of the appropriate contract application and processing fees. <br /> <br />CE20050145 <br />
