F <br />~~ PEDESTRIAN/BIKE EASEMENT -BAKER PETROI_ITE CORPORATION <br />STATE OF TEXAS § <br />COUNTY OF HARRIS § <br />KNOW ALL MEN BY THESE PRESENTS: <br />That the undersigned Baker Petrolite Corporation , a Delaware corporation, <br />(hereinafter called "Grantor"), far and in the consideration of the sum of TEN DOLLARS Q <br />($10,00} in hand paid and other gaol and valuable consideration, the receipt and sufficiency of ~~ ~` Imo'" <br />which are hereby acknowledged, does hereby seN, transfer and assign unto the CITY QF LA ~ <br />P4RTE a municipal corporation of Harris County {hereinafter calved "Grantee"), a perpetual <br />easement to, at any time and from time to time, construct, maintain, inspect and repair a <br />concrete pedestrianlbike trail and its appurtenances. "I'he herein easement shall have an <br />overall permanent width of ten feet {10'). This easement is dedicated solely for the location of a <br />pedestrianlbike trail and its appurtenances as described; <br />A ten feet (10°}wide strip of land consisting of 0.5212 acres of land situated in the <br />William M. Jones Survey, Abstract No. 482 in Harris County, Texas; being a park of that <br />certain '125.179 acre tract of land described in the deed to Baker Pe#rolite Carpara#iion <br />recorded in Harris Caunty Clerks File No. E340787, Official Public Records of Real <br />Property of Harris Caunty, Texas, said 0.5212 acre,tract of land as described by metes <br />and bounds and drawing consisting of three (3} pages found in EXHIBIT `°A". <br />The Grantor further grants and conveys to the Grantee the right of ingress/egress on <br />and through the ten feet (10') strip of land for all purposes necessary or incidental to exercise <br />the rights herein granted. The ten feet (10'} easement shall be reserved exclusively for the <br />location of a concrete pedestrianlbike trail and appurtenances. The Grantee shall not increase <br />trail width without prior written consent from the Grantor, its successors and assigns. <br />Grantor reserves the right to use and enjoy said lands except as may be necessary for <br />purposes herein granted, provided grantor shaft not construct or permit to be constructed any <br />structure, reservoir or any other obstruction or excavation on, aver or within said permanent <br />easement. However, Grantor specifically reserves the right for perpendicular crossings of <br />Grantee's easement with fences, pipelines, roads, streets, driveways, water lines, sanitary <br />sewer lines and other utilities or facilities and to be constructed as not to interfere with <br />Grantee's pedestrianlbike trail. <br />This conveyance shalt remain in effect for so long as the property described herein is <br />used by Grantee for a pedestrianlbike traiE, after which this easement shall lapse. <br />"the terms and provisions hereof shalt be binding upon and shall insure to the benefit of <br />heirs, personal representatives, successors and assigns of Grantor and Grantee. <br />Page 1 c~F? <br />
