RECEIVED NOV 0 4 2009~ CITY seCRETARY'S OFFice STATE OF TEXAS S COUNTY OF HARRIS S KNOW ALL MEN BY THESE PRESENTS: That the undersigned CBSL TRANSPORTATION SERVICES, a corporation, (hereinafter called "Grantor"), for and in the consideration of the sum of TEN DOLLARS ($10.00) in hand paid and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell, warrant and convey unto the l fl tl CITY OF LA PORTE a municipal corporation of Harris County (hereinafter called "Grantee"), a f-X-J'-- perpetual easement to, at any time and from time to time, construct, maintain, inspect and repair a concrete pedestrian/bike trail and its appurtenances. The herein easement shall have an overall permanent width of ten feet (10'). This easement is dedicated solely for the location of a pedestrian/bike trail and its appurtenances as described: A ten foot (10') wide strip of land consisting of 0.2148 acres of land situated in the William M. Jones Survey, Abstract No. 482 in Harris County, Texas; being a part ofthat certain 4.6242 acre tract of land described in the deed to CBSL Transportation Services, Inc. recorded in Harris County Clerks File No. T998436, Official Public Records of Real Property of Harris County, Texas, together with that certain 2.3417 acre tract of land described in the deed to the same recorded in Harris County Clerks File No. 5939476, Official Public Record of Real Property of Harris County, Texas, together with that certain 2.3417 acre tract of land described in the deed to the same recorded in Harris County Clerks File No. 5730572, Official Public Record of Real Property of Harris County, Texas, together with that certain 12.0000 acre tract of land described in the deed to the same recorded in Harris County Clerks File No. P001997, Official Public Record of Real Property of Harris County, Texas, said 0.2148 acre tract of land as described by metes and bounds and drawing consisting of three (3) pages found in EXHIBIT "A". The Grantor further grants and conveys to the Grantee the right of ingress/egress on and through the ten feet (10') strip of land for all purposes necessary or incidental to exercise the rights herein granted. The ten feet (10') easement shall be reserved exclusively for the location of a concrete pedestrian/bike trail and appurtenances. The Grantee shall not increase trail width without prior written consent from the Grantor, its successors and assigns. Grantor reserves the right to use and enjoy said lands except as may be necessary for purposes herein granted, provided grantor shall not construct or permit to be constructed any structure, reservoir or any other obstruction or excavation on, over or within said permanent easement. However, Grantor specifically reserves the right for perpendicular crossings of Grantee's easement with fences, pipelines, roads, streets, driveways, water lines, sanitary sewer lines and other utilities or facilities and to be constructed as not to interfere with Grantee's pedestrian/bike trail. The terms and provisions hereof shall be binding upon and shall insure to the benefit of heirs, personal representatives, successors and assigns of Grantor and Grantee. Page 1 of2
