I <br />Lf <br /> <br />;l';\\ <br />~ I ji <br /> <br />1'\" <br />1 <br /> <br />}i~~~ <br />,~j <br /> <br />I <br />~'l <br /> <br />~I <br />I <br />, <br />I <br />~ <br />!~l <br />!::l <br /> <br />t~~ <br /> <br />~ <br /> <br />20090489985 <br />10/28/2009 RP2 '48.00 <br /> <br />PEDESTRIAN AND BICYCLE EASEMENT <br /> <br />STATE OF TEXAS ~ <br />COUNTY OF HARRIS ~ <br /> <br />RECEIVED <br /> <br />NOV 0 4 2009 <br />CITV SECRETARV'S <br />OF"ce <br /> <br />That the undersigned Coastal Water Authority, a conservation and reclamation district <br />created pursuant to the Constitution and laws of the State of Texas (formerly known as Coastal <br />Industrial Water Authority) (the "Grantor"), for and in the consideration of the sum of TEN <br />DOLLARS ($10.00) in hand paid and other good and valuable consideration, the receipt and <br />sufficiency of which is hereby acknowledged, does hereby grant and convey to the City of La <br />Porte, a municipal corporation of Harris County (the "Grantee") subject to the existing rights, <br />restrictions and encumbrances, the reserved rights of Grantor and the terms and conditions <br />described below (collectively, the "Conditions"), a non-exclusive easement solely for the <br />purpose of constructing, maintaining, inspecting and repairing a concrete pedestrian and bicycle <br />trail and appurtenances thereto for recreational use (the "Easement") upon and over the surface <br />of a tract ofland described as follows: <br /> <br />A ten feet (10') wide strip of land, more or less, consisting of 0.0854 acres of land <br />situated in the William M. Jones Survey, Abstract No. 482 in Harris County, <br />Texas; being a part of that certain 18.298 acre tract of land designated as Parcel <br />"A" and described in the deed to Coastal Water Authority recorded in Harris <br />County Clerks File No. K874511, Official Public Records of Real Property of <br />Harris County, Texas, together with a portion of that certain 29.981 acre tract of <br />land designated as Tract "A" and described in the deed to Coastal Industrial <br />Water Authority recorded in Harris County Clerks File No. E819078, Official <br />Public Records of Real Property of Harris County, Texas (together, the "Coastal <br />Deeds"), said 0.0854 acre tract of land as described by metes and bounds and <br />drawing consisting of three (3) pages found in EXHIBIT "A" attached hereto and <br />incorporated herein for all purposes (the "Easement Tract"). <br /> <br />:0 <br /> <br />Subject to the Conditions, the Grantor further grants and conveys to the Grantee the right <br />of ingress and egress on and through the Easement Tract for all purposes necessary or incidental <br />to Permitted Use (defined below). <br /> <br />The grant of this Easement is made expressly subject to the following Conditions: <br /> <br />(A) The Easement shall be used solely for the purpose of constructing, maintaining, <br />inspecting and repairing a concrete pedestrian and bicycle trail and appurtenances thereto upon <br />and over the surface of the Easement Tract for recreational use (the "Permitted Use") and for no <br />other purposes whatsoever. <br /> <br />(B) The Easement shall be non-exclusive and shall be subject to all existing <br />easements and rights-of-way, whether of record or not, which may be located within the <br />Easement Tract and the rights of any easement holders thereto, and to any and all reserved rights, <br /> <br />1086423v.3 <br />
