<br />By way of this instrument, Exxon Land Development, Inc., formerly ~~

<br />Friendswood Development Company, an Arizona corporation, duly authorized to do

<br />business in the State of Texas, whose mailing address is P.O. Box 2567,

<br />Houston, Texas 77252-2567, ("Grantor"), for and in consideration of the sum of

<br />Ten Dollars ($10.00) cash and other good and valuable consideration, the

<br />receipt and sufficiency of which are hereby acknowledged and confessed by

<br />City of La Porte, Texas, a municipal corporation, a ten foot (10 ') non-

<br />exclusive right-of-way and easement for a concrete pedestrian and bicycle

<br />trail, out of the real estate previously conveyed by Grantor to Grantee, being

<br />1) two tracts of land containing together 67.408 acres of land, and conveyed by

<br />instrument dated June 29, 1976, and recorded under Harris County Clerk's File

<br />No. E819078 on July 9, 1976, and 2) two tracts of land containing together
<br />
<br />approximately 22.763 acres, and conveyed by instrument dated December 10, 1986,
<br />
<br />and recorded under Harris County Clerk's File No. K874511 on December II, 1986.

<br />The authorization and consent hereby granted are given only for the
<br />
<br />limited purpose of allowing Grantee to convey an easement to the City of La
<br />
<br />Porte, Texas, for a ten foot (10') pedestrian and bicycle trail, and for all
<br />
<br />other purposes Grantee shall continue to be subject to the reservations,
<br />
<br />limitations, and restrictions pertaining to the use of the subject tracts, as
<br />
<br />described and incorporated in said June 29, 1976, and December 10, 1986
<br />
<br />instruments.
