<br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />lfi <br />Ii"'! <br /> <br />,f! <br />'JI/I:I <br />~ilWl <br />IJ~I <br />I <br />I <br />j:J~~ <br />~j <br /> <br />A ten foot (10') wide strip of land consisting of 0.0534 acres of land situated in the Richard <br />Pearsall Survey, Abstract No. 625 in Harris County, Texas; being a part of Unrestricted <br />Reserve" A" of Goodyear Bayport 2003, a subdivision recorded in Harris County Film <br />Code No. 535041, Map Records of Harris County, Texas; being a part of that certain 75 <br />acre tract of land described in the deed to The Goodyear Tire & Rubber Company <br />recorded in Harris County Clerks File No. F539980, Official Public Records of Real <br />Property of Harris County, Texas, said 0.0534 acre tract of land as described by metes and <br />bounds and drawing consisting of three (3) pages found in Exhibit "A." <br /> <br />I <br />1 <br />I~) <br />j,!f!ijt <br />Idjj<! <br /> <br />The Grantor further grants and conveys to the Grantee the right of ingress/egress on and <br />through the ten feet (10') strip of land for all purposes necessary or incidental to exercise the <br />rights herein granted. The ten feet (10') easement shall be reserved exclusively for the location <br />of a concrete pedestrianlbike trail and appurtenances. The Grantee shall not increase trail width <br />without prior written consent from the Grantor, its successors and assigns. <br /> <br />~i <br /> <br />%: <br /> <br />Grantor reserves the right to use and enjoy said lands in ways that are not inconsistent <br />with the purposes herein granted, including for underground pipelines, waterlines, sanitary sewer <br />lines and other utilities or facilities currently existing or constructed in the future under the <br />easement area. Grantor also reserves to itself the right for perpendicular crossings of Grantee's <br />easement with fences, roads, streets, driveways, and the like currently existing or to be <br />constructed provided same do not unreasonably interfere with Grantee's pedestrian/bike trail. <br /> <br />The failure of Grantee to exercise any of the rights granted hereby, in whole or in part, <br />for any period exceeding five (5) years duration shall constitute an abandonment of this <br />easement. <br /> <br />As a further consideration of the above grant, the Grantee, for itself, its successors and <br />assigns, by the exercise of the rights herein granted, agrees as follows: (1) that it will perform all <br />necessary permitted work with due diligence and without unnecessary delay after beginning the <br />same and that it will promptly restore all surrounding lands and improvements, including <br /> <br />1 <br />
