LP <br />STATE OF TEXAS S <br />COUNTY OF HARRIS S <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />RECEIVED <br />NOY 04 2009 <br /> <br />CITY SECRETARY'S <br />OFFIC.e <br /> <br />That the undersigned GSL PARTNERS SUB SEVEN, LP, a Texas Limited Partnership, <br />(hereinafter called "Grantor"), for and in the consideration of the sum of TEN DOLLARS ($10.00) <br />in hand paid and other good and valuable consideration, the receipt and sufficiency of which is III /J / <br />hereby acknowledged, does hereby grant, bargain, sell, warrant and convey unto the CITY OF LA JL-L/ <br />PORTE a municipal corporation of Harris County (hereinafter called "Grantee"), a perpetual <br />easement to, at any time and from time to time, construct, maintain, inspect and repair a concrete <br />pedestrian/bike trail and its appurtenances. This easement is dedicated solely for the location of a <br />pedestrian/bike trail and its appurtenances as described: <br /> <br />A Ten Feet (10') Wide Strip Of Land For Pedestrian Access, Running Primarily East-West, And <br />Located Entirely Within The Existing 50' Platted Conservation Easement In The 2.8159 Acres Of <br />Land, Out Of Restricted Reserve "A", Of Bayport North Industrial Park, As Recorded In Film <br />Code No. 437010 Of The Harris County Map Records And Also Being Out Of That Certain Called <br />110.5334 Acre Tract Of Land Described In A Deed Dated 11-08-1999 From Don L. Tuffli, Trustee To <br />Bayport North Industrial Park, L.P. Filed For Record In The Official Public Records Of Real Property Of <br />Harris County, Texas At Clerk's File No. U-Q74535, Film Code No. 529-10-2591; And <br /> <br />D <br /> <br />A Ten Feet (10') Wide Strip Of Land For Pedestrian Access, Running Primarily East-West, And <br />Located Entirely Within The Existing 50' Platted Conservation Easement In The 2.3607 Acres Of <br />Land, Out Of Restricted Reserve "B", Of Bayport North Industrial Park, According To The Plat <br />Thereof Filed At Film Code No. 437010 Of The Harris County Map Records And Also Being Out Of <br />That Certain Called 110.5334 Acre Tract Of Land Described In A Deed Dated 11-08-1999 From Don <br />L. Tuffli, Trustee To Bayport North Industrial Park, L.P. Filed For Record In The Official Public Records Of <br />Real Property Of Harris County, Texas At Clerk's File No. U-074535, Film Code No. 529-10-2591. <br /> <br />The Grantor further grants and conveys to the Grantee the right of ingress/egress on and <br />through the ten feet (10') strip of land for all purposes necessary or incidental to exercise the rights <br />herein granted. The ten feet (10') easement shall be reserved exclusively for the location of a <br />concrete pedestrianlbike trail and appurtenances. The Grantee shall not increase trail width <br />without prior written consent from the Grantor, its successors and assigns. <br />Grantor reserves the right to use and enjoy said lands except as may be necessary for <br />purposes herein granted, provided grantor shall not construct or permit to be constructed any <br />structure, reservoir or any other obstruction or excavation on, over or within said permanent <br />easement. However, Grantor specifically reserves the right for perpendicular crossings of <br />Grantee's easement with fences, pipelines, roads, streets, driveways, water lines, sanitary sewer <br />lines and other utilities or facilities and to be constructed as not to interfere with Grantee's <br />pedestrian/bike trail. <br /> <br />Page 1 of2 <br />
