Gt u, ^ r'\, representing Notsuoh Development <br />Corporation, a corporation, (herein after called "Grantor"), for and in the consideration of the <br />sum of TEN DOLLARS ($10.00) in hand paid and other good and valuable consideration, the <br />~pt and sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell, )# Il <br />warrant and convey unto the CITY OF LA PORTE a municipal corporation of Harris County I~ <br />(hereinafter called "Grantee"), a perpetual easement to, at any time and from time to time, <br />construct, maintain, inspect and repair a concrete pedestrlanlblke trail and its appurtenances. <br />The herein easement shall have an overall permanent width of ten feet (10'). Jones Survey, Abstract No. 482 in Harris County, Texas; being part of that <br />certain 49.366 acre tract of land described in the deed to Notsuoh Development <br />Corporation recorded In Harris County Clerks Ale No. 20080480467, OffIcial Public <br />Records of Real Property of Harris County"Texas, said 0.3621 acre tract of land as <br />described by metes and bounds and drawing consisting of three (3) pages found in <br />EXHIBIT "A". <br /> <br />The Grantor further grants and conveys to the Grantee the right of ingress/egress on <br />and through the ten feet {1 O'} strip of land for all purposes neCessary or incidental to ~xercise <br />the rights herein granted. The ten feet {10'} easement shall be reserved exclusively for the <br />location of a concrete pedestrianlbike trail and appurtenances. The Grantee shall not Increase <br />trail width without prior written consent from the Grantor, Its successors and assigns. <br />Grantor reserves the right to use and enjoy said lands except as may be necessary for <br />purposes herein granted, provided grantor shall not construct or permit to be constructed any <br />structure. reservoir or any other obstruction or excavation on, over or within said pennan~nt <br />easement However, Grantor speclflcally reserves the right for perpendicular crossings of <br />Grantee's easement with fences, pipelines, roads, streets, driveways.
