<br />{) <br />o\~ <br /> <br />j ) <br />,.,1, ) <br />,... <br />:.\ <br />, <br /> <br />j:~i~J <br /> <br />'ll <br />t t <br />!:fl~ <br /> <br />'ij1"! <br />i <br />i <br />jlJiff; <br />;~r \ <br />j~' <br />'I~~ <br />I <br />i~~ <br />lJ~1 <br />I,.IJ <br />ilt~1 <br />:llIuf <br /> <br />.~ <br />1-1.1 <br />1:= <br /> <br />20090525112 <br />11/18/2009 RP3 $20.00 <br />COMMITMENTS OF CITY OF LA PORTE, TEXAS <br />FOR USE OF PEDESTRIAN AND BICYCLE EASEMENT <br /> <br />By way of this instrument, the City of La Porte, Texas, a municipal corporation, in <br />consideration of having been granted a ten foot (10') non-exclusive right-of-way and easement for a <br />concrete pedestrian and bicycle trail ("Trail System" herein) by Three Sisters Trust, which <br />conveyances are recorded in Harris County Clerks File No. 20090522811; and Tuftli Company, Ine., <br />which conveyances are recorded in Harris County Clerks File No. 20090522812; and Don and <br />Martha Tuffii Family Trust, which conveyances are recorded in Harris County Clerks File No. <br />20090522813 in the Official Public Records of Real Property of Harris County, Texas, respectively; <br />does hereby make the following commitments and representations to the aforesaid entities in <br />connection with the operation and maintenance of said trail system: <br /> <br />1) Texas Department of Licensing and Regulation and ADA compliant design: The <br />City of La Porte, Texas has designed the trail system to be fully compliant with all state and <br />federal laws, rules and regulations requiring accessibility by disabled persons. <br /> <br />2) Conflict with existing irrigation system: The City of La Porte, Texas will repair <br />any damage to the existing irrigation system locate adjacent to the trail system caused by <br />construction of the trail system or make necessary adjustments where the trial system requires <br />modification to the system so as to continue providing a level of irrigation coverage previously <br />provided. <br /> <br />3) Signage to prevent trespass: The City of La Porte, Texas will install signage on <br />the south side of the trail system that states "Private property, no trespassing" as a warning to <br />users of the trail system. <br /> <br />4) Indemnity: The City of La Porte does hereby pledge that it will indemnify and ~ V <br />hold harmless Three Sisters Trust, Tuffii Company, Inc., and Don and Martha Tuffii Family .:J [" ' <br />Trust, for and from any claims, suits, or actions, and damages awarded in connection therewith, <br />brought against said entities, to the extent any such claim, suit, action, or damages are ultimately <br />found to be the result of the actions or omissions of the City of La Porte <br />
