This easement is dedicated solely for the location of a <br />pedestrian/bike trail and its appurtenances as described: <br /> <br />A ten feet (10') wide strip of land for pedestrian access, running primarily east-west, and located <br />entirely within the existing 50' platted Conservation Easement in the 3.3451 acres of land out of <br />Restricted ReseNe "A", Bayport North Industrial Park according to the plat thereof filed at Film Code No. 437010, <br />Harris County Map Records, also being out of that certain called 110.5334 acre tract of land described in a deed <br />dated November 8,1999, from Don L Tuffli, Trustee to Bayport North Industrial Park, L.P., filed for record in the <br />Official Public Records of Real Property of Harris County, Texas, at Clerk's File No. U074535, Film Code No. <br />529-10-2591, out of the William M. Jones SUNey, A-482, Harris County, Texas William M. Jones Survey, <br />Abstract No. 482 in Harris County, Texas. <br /> <br />The Grantor further grants and conveys to the Grantee the right of ingress/egress on and <br />through the ten feet (10') strip of land for all purposes necessary or incidental to exercise the rights <br />herein granted. The ten feet (10') easement shall be reserved exclusively for the location of a <br />concrete pedestrian/bike trail and appurtenances. The Grantee shall not increase trail width <br />without prior written consent from the Grantor, its successors and assigns. <br />Grantor reserves the right to use and enjoy said lands except as may be necessary for <br />purposes herein granted, provided grantor shall not construct or permit to be constructed any <br />structure, reservoir or any other obstruction or excavation on, over or within said permanent <br />easement.
