Development, a Limited Partnership, (hereinafter <br />called "Grantor"), for and in the consideration of the sum of TEN DOLLARS ($10.00) in hand <br />paid and other good and valuable consideration, the receipt and sufficiency of which is hereby <br />acknowledged, does hereby grant, bargain, sell, warrant and convey unto the CITY OF LA <br />PORTE a municipal corporation of Harris County (hereinafter called "Grantee"), a perpetual <br />easement to, at any time and from time to time, construct, maintain, inspect and repair a <br />concrete pedestrian/bike trail and its appurtenances. The herein easement shall have an <br />overall permanent width of ten feet (10'). This easement is dedicated solely for the location of a <br />pedestrian/bike trail and its appurtenances as described: <br /> <br />COUNTY OF HARRIS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />(U/ <br /> <br />A ten feet (10') wide strip of land consisting of 0.0153 acres of land situated in the <br />William M. Jones Survey, Abstract No. 482 in Harris County, Texas; being a part of <br />Restricted Reserve "A" Block 1, Tredco, a subdivision recorded in Harris County Film <br />Code No. 623117, Map Records of Harris County, Texas, said 0.0153 acre tract of land <br />as described by metes and bounds and drawing consisting of three (3) pages found in <br />EXHIBIT "A". <br /> <br />The Grantor further grants and conveys to the Grantee the right of ingress/egress on <br />and through the ten feet (10') strip of land for all purposes necessary or incidental to exercise <br />the rights herein granted. The ten feet (10') easement shall be reserved exclusively for the <br />location of a concrete pedestrian/bike trail and appurtenances. The Grantee shall not increase <br />trail width without prior written consent from the Grantor, its successors and assigns. <br />Grantor reserves the right to use and enjoy said lands except as may be necessary for <br />purposes herein granted, provided grantor shall not construct or permit to be constructed any <br />structure, reservoir or any other obstruction or excavation on, over or within said permanent <br />easement. However, Grantor specifically reserves the right for perpendicular crossings of <br />Grantee's easement with fences, pipelines, roads, streets, driveways, water lines, sanitary <br />sewer lines and other utilities or facilities and to be constructed as not to interfere with <br />Grantee's pedestrian/bike trail. <br />The terms and provisions hereof shall be binding upon and shall insure to the benefit of <br />heirs, personal representatives, successors and assigns of Grantor and Grantee. <br /> <br />DULY executed this 1 ~ day of Jt( He-- , 2009 <br /> <br />Tredco L.P.
