<br />WHEREAS, CHRIST LUTHERAN CHURCH OF LA PORTE, a Texas non-
<br />profit corporation, d/b/a "LIGHT OF CHRIST", 2530 South Broadway
<br />Street, La Porte, Texas 77571 (hereinafter called "Grantor"), for
<br />and in consideration of the sum of Ten Dollars ($10.00) in hand
<br />paid and other good and valuable consideration, the receipt and
<br />sufficiency of which is hereby acknowledged, does hereby grant, I ()d
<br />bargain, sell, warrant and convey unto the CITY OF LA PORTE, a ~
<br />municipal corporation, 604 West Fairmont Parkway, La Porte, Texas
<br />77571 (hereinafter called "Grantee"), a perpetual easement to, at
<br />any time and from time to time, construct, maintain, inspect,
<br />repair and replace City of La Porte water and sewer lines and
<br />appurtenances. The herein easement shall have an overall permanent
<br />width of ten feet (10'). Grantee may use an additional temporary
<br />construction space ten feet (10') in width adjacent to the
<br />permanent easement of the landowner's adjacent land as needed, for
<br />construction purposes, with this right of use of temporary
<br />construction space terminating upon completion of the initial
<br />construction. This easement is dedicated solely and exclusively
<br />for the location of City of La Porte public utilities and
<br />appurtenances, and shall not be available to other public utilities
<br />holding franchises from the City of La Porte. This public utility
<br />easement shall not be a part of any future subdivision platting,
<br />and shall remain free and clear of any 1 iens or encumbrances. This
<br />easement is described as follows, to-wit:

<br />Being all that certain 0.1141 acre (4,972 sq.ft.)
<br />easement situated in the W.P. Harris Survey, A-30, Harris
<br />County, Texas, and being out of a called 4.505 acre tract
<br />conveyed to Christ Lutheran Church of La Porte as
<br />recorded in Harris County Clerk's File (H.C.C.F.) No.
<br />X892367, dated September 2, 2004, said 0.1141 acre
<br />easement being more particularly described on Exhibit "A"
<br />attached hereto, incorporated by reference herein, and
<br />made a part hereof for all purposes.

<br />Being all that certain 0.0285 acre (1,245 sq.ft.)
<br />easement situated in the W.P. Harris Survey, A-30, Harris
<br />County, Texas, and being out of a called 2.220 acre tract
<br />conveyed to Christ Lutheran Church of La Porte as
<br />recorded in Harris County Clerk's File (H.C.C.F.) No.
<br />X892366, dated September 2, 2004, said 0.0285 acre
<br />easement being more particularly described on Exhibit "B"
<br />attached hereto, incorporated by reference herein, and
<br />made a part hereof for all purposes.
