<br />CONSENT OF SECURITY AGREEMENT HOLDER TO RIGHT OF W A Y/ EASEMENT <br /> <br />WHEREAS, US Bank National Association (as successor to State Street Bank and Trust Company), as <br />trustee for the registered holders of Chase Manhattan Bank First Union National Bank Commercial <br />Mortgage Trust, Commercial Mortgage Pass-Through Certificates, Series 1999-1 (hereinafter referred to <br />as the "Lender") is the current holder of that certain Deed of Trust, Assignment of Rents and Security <br />Agreement (hereinafter referred to as the "Security Agreement") from Forest Vista Mobile Home <br />Community, LLC, a Texas limited liability company (hereinafter referred to as the "Borrower") dated <br />June 14, 1999; and <br /> <br />WHEREAS, Borrower, the current owner of the property secured by said Security Agreement, has <br />granted certain easements as more particularly described in the City of La Porte Utility Easement <br />recorded immediately prior hereto and to which this Consent of Security Agreement Holder to Right of <br />Way/Easement is attached. <br /> <br />iJ;i <br />:ll!\; <br />\, ' <br />~lj <br /> <br />I!<r! <br /> <br />NOW THEREFORE, in consideration of the sum of One ($1.00) Dollar in hand paid to Lender, the <br />receipt and sufficiency of which is hereby acknowledged by Lender, Lender does hereby join in the <br />easement interest conveyed by Borrower, for the purpose of consenting to the grant of said easements and <br />for the further purpose of subordinating its security interest in said property to the same.
