<br />2011.0032244 <br />01/24/2011 RPl $116.00 <br /> <br />Z'o'. ~ <br />ta.'D\'\:\ STATE OF TEXAS <br />COUNTY OF HARRIS <br /> <br />PEDESTRIAN AND BICYCLE EASEMENT <br /> <br />s <br />s <br /> <br />o <br /> <br />l~ <br />(:0 <br />'Ij4 <br />l/~ <br />I <br />I <br />(:~ <br />CO <br />I <br />J,I <br />r, <br />!'II <br />Q <br /> <br />That the undersigned Coastal Water Authority, a conservation and reclamation district <br />created pursuant to the Constitution and laws of the State of Texas (formerly known as Coastal <br />Industrial Water Authority) (the "Grantor"), for and in the consideration of the sum of FIVE <br />THOUSAND AND NOll 00 DOLLARS ($5,000.00) in hand paid and other good and valuable <br />consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby grant <br />and convey to the City of La Porte, a municipal corporation of Harris County (the "Grantee") <br />subject to the existing rights, restrictions and encumbrances, the reserved rights of Grantor and <br />the terms and conditions described below (collectively, the "Conditions"), a non-exclusive <br />easement solely for the purpose of constructing, maintaining, inspecting and repairing a concrete <br />pedestrian and bicycle trail and appurtenances thereto for recreational use (the "Easement") <br />upon and over the surface of a tract of land described as follows: <br /> <br />ltV <br /> <br />A ten feet (10') wide strip ofland, more or less, consisting of a 0.1131 acre tract <br />of land situated in the William M. Jones Survey, Abstract No. 482 in Harris <br />County, Texas and being a portion of that certain 16.72 acre tract ofland described <br />in the Judgment to Coastal Industrial Water Authority recorded in Harris <br />County Clerks File No. E165986, Official Public Records of Real Property of <br />Harris County, Texas (the "Coastal Deed"); said 0.1131 acre tract of land as <br />described by metes and bounds in EXHIBIT "A-I" and depicted in EXHIBIT "A- <br />2", both attached hereto and incorporated herein for all purposes (the "Easement <br />Tract"). <br /> <br />D <br /> <br />,;11 <br />i.!wi <br />~ <br /> <br />Subject to the Conditions, the Grantor further grants and conveys to the Grantee the right <br />of ingress and egress on and through the Easement Tract for all purposes necessary or incidental <br />to Permitted Use (defined below). <br /> <br />The grant ofthis Easement is made expressly subject to the following Conditions: <br /> <br />(A) The Easement shall be used solely for the purpose of constructing, maintaining, <br />inspecting and repairing a concrete pedestrian and bicycle trail and appurtenances thereto upon <br />and over the surface of the Easement Tract for recreational use (the "Permitted Use") and for no <br />other purposes whatsoever. <br /> <br />(B) The Easement shall be non-exclusive and shall be subject to all eXlstmg <br />easements and rights-of-way, whether of record or not, which may be located within the <br />Easement Tract and the rights of any easement holders thereto, and to any and all reserved rights, <br />restrictions, covenants, encumbrances and mineral and royalty reservations or interests of record <br />in the Official Public Records of Harris County, Texas which may affect the Easement Tract <br />(collectively, the "Prior Interests").
