i / (1ell STATE OF TEXAS ~ () COUNTY OF HARRIS DRAINAGE EASEMENT ) } 2011007'0431 02/18/2011 RP2 $20.00 KNOW ALL MEN BY THESE PRESENTS: ~ That the undersigned Jesus Lozano, Jr. (herein after called "Grantor"), for and in the consideration of the sum of TEN DOLLARS ($10.00) in hand paid and other good valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell, warrant and convey unto the CITY OF LA PORTE a municipal corporation of t't( Harris County (hereinafter called "Grantee"), a perpetual easement to, at any time and from , {/ time to time, construct, maintain, inspect and repair a drainage easement. The herein easement shall have an overall permanent width of forty feet (40'). This easement is dedicated solely for the location of an above and below ground drainage swale/apparatus as described: A forty foot (40') wide strip of land along the south line of Lot 4 of La Porte Outlots, () Harris County Texas '-/ 11"'1 l~\! \1": The Grantor(s} further grants and conveys to the Grantee the right of ingress/egress on and through the forty feet (40') strip of land for all purposes necessary or incidental to exercise the rights herein granted as well as the most direct access to the easement from Grantors private property. The forty foot (40') easement shall be reserved exclusively for the location of an above and below ground drainage swale/apparatus. Grantor reserves the right to use and enjoy said lands except as may be necessary for purposes herein granted, provided grantor shall not construct or permit to be constructed any structure, reservoir or any other obstruction or excavation on, over or within said permanent easement. However, Grantor specifically reserves the right for perpendicular crossings of Grantee's easement with pipelines, roads, streets, driveways, water lines, sanitary sewer lines and other utilities or facilities and to be constructed as not to interfere with Grantee's above ground swale. The terms and provisions hereof shall be binding upon and shall insure to the benefit of heirs, personal representatives, successors and assigns of Grantor and Grantee.
