Ordinance No. 1175, Page 7. <br />• review. At least ninety (90) days prior to the 5th and loth <br />Anniversary Dates of this franchise, the City Clerk shall notify <br />Grantee of the day and time of the hearing. At the hearing, <br />Grantee shall be entitled to all the rights of due process, <br />including but not limited to, the right to present evidence, <br />the right to cross-examine and the right to be represented by <br />counsel. All records and minutes of each of the performance <br />evaluation hearings shall be retained by the City Clerk and be <br />available for inspection throughout the term of the franchise. <br />C. Renewal. City Commission shall hold a public hearing <br />not less than twelve (12) months prior to the expiration date of <br />this franchise, the purpose of which will be to review Grantee's <br />performance during the entire term of its franchise, to consider <br />the adequacy of this franchise from the standpoint of City, <br />Grantee and FCC's rules for cable television and to determine <br />the advisability of renewing Grantee's franchise for an addi- <br />tional period of years. City Commission shall hear any inter- <br />ested persons during such hearings and shall determine whether <br />Grantee did reasonably comply with the terms and conditions <br />imposed by this franchise. If City Commission determines that <br />the Grantee's performance has been satisfactory in accordance <br />• with the terms and conditions imposed by this franchise, City <br />Commission may renew Grantee's franchise for an additional four- <br />teen year period. <br />Section 5. ADDITIONS TO FRANCHISE AREA BY ANNEXATION. <br />The Franchise Area shall include territory which is annexed <br />by or consolidated with City during the term of this franchise. <br />Section 6.
