Construction of Franchise. By acceptance of this <br /> <br />franchise, Grantee acknowledges that it has carefully read the <br /> <br />provisions hereof and is willing to and does accept all of the <br /> <br />risks of the meanings of such provisions and agrees that in the <br /> <br />event of any ambiguity herein or in the event of any other <br /> <br />dispute over the meaning thereof, the same shall be construed <br /> <br />strictly against Grantee and in favor of City. <br /> <br />Section 34. ACCEPTANCE OF FRANCHISE. <br /> <br />Within fifty (50) days from the date of the final reading <br /> <br />of this ordinance, Grantee shall file with the City Clerk a <br /> <br />written statement in the following form signed in its name and <br /> <br />behalf: <br /> <br />"To the Honorable Mayor and City Commission of the City of <br /> <br />La Porte, Texas: <br /> <br />"For itself, its successors and assigns, KIP-LEE CATV, INC., <br /> <br />d/b/a LA PORTE CABLE TELEVISION, a Texas corporation, hereby <br /> <br />accepts the attached ordinance and agrees to be bound by all of <br /> <br />its terms, conditions and provisions. <br /> <br />KIP-LEE CATV, INC. <br />d/b/a LA PORTE CABLE TELEVISION <br /> <br />By <br /> <br />President <br /> <br />"Dated this the <br /> <br />day of January, 1980." <br />
