PlanningandZoningCommissionRegularMeeting <br />March19,2015 <br />BeachParkͻ/źƩĭƌĻƭͼZoneChange <br />Inorderfortheseregulationstotakeeffect,thecityhasinitiatedarezoneofall <br />propertiesintheBeachParkSubdivisionthatarecurrentlyzonedNCtotheMUdistrict. <br />ThePlanningandDevelopmentDepartmentconductedaNeighborhoodMeetingon <br />February5,2015,toeducatepropertyownersandresidentsoftheBeachPark <br />Subdivisionͻ/źƩĭƌĻƭͼwhatrezoningofthepropertywouldmeantothemasresidents <br />andhomeowners. <br />TheattachedExhibitAshowsthezoningofthesubjectpropertyandsurrounding <br />properties.Additionally,theattachedExhibitBidentifiesthesubjectpropertiesas <br />MixedUseintheĭźƷǤ͸ƭFutureLandUseMap.TheMixedUselandusedesignationwas <br />addedtotheĭźƷǤ͸ƭFutureLandUseMapthroughtheComprehensivePlanapprovedin <br />2012toprovidedevelopmentoptionsforpropertyownersinthearea. <br />: <br />NotificationRequirements <br />StafffindsthatthepublichearingnotificationrequirementsoutlinedinSection106171 <br />wereperformedinaccordancewithcodeprovisions,includingthefollowing:noticeina <br />newspaperofgeneralcirculationatleast15dayspriortothehearing;writtennotice <br />mailedtoownersofrealpropertywithin200feetofthesitewithin10daysofthe <br />hearingandinthiscasenoticewassenttoallpropertyownersandresidentswithinthe <br />rezoningarea;4signswerepostedintheareaoftherezoningwithin15daysofthe <br />hearing.Inaccordancewithstatelaw,noticeofthepublichearingwasalsopostedat <br />CityHallandonthe/źƷǤ͸ƭwebsite. <br />Analysis: <br />Thereareanumberofdifferentconsiderationsstaffevaluatedduringthereviewofthis <br />application.ThefollowingdescribesƭƷğŅŅ͸ƭanalysisofthoseconsiderations: <br />1.LandUse.ThesubjectsiteiscurrentlyzonedNeighborhoodCommercial(NC)and <br />the/źƷǤ͸ƭadoptedFutureLandUseMapidentifiesitasMixedUse.Therezoning <br />ofthesubjectpropertiestoMixedUse(MU)willbeconsistentwiththeĭźƷǤ͸ƭ <br />ComprehensivePlanthatestablishedinthe2012updatetheselotsasfuture <br />ͻaźǣĻķ <br />ƭĻͼtoprovideflexibilityfordevelopmentoptionstotheseproperties. <br />AlthoughtheMUdistrictallowsforsinglefamilydetachedresidentialconstruction, <br />italsoprovidesflexibility,shouldthemarketdemandinthefuturechange,toallow <br />forlimitedcommercialdevelopment. <br />2.Access.Thereissufficientrightofwayaccesstoallowthevariouslotsto <br />develop. <br />3.Utilities.Waterandsewerlinesarealreadyexistinginthevicinity,therefore <br />allowingforpropertiestotapintothoseutilities. <br />Additionally,the/źƷǤ͸ƭComprehensivePlanidentifiesanumberofitemstobe <br />consideredpriortomakinglandusedecisions.Thefollowingtablebreaksdowneach <br />itemandƭƷğŅŅ͸ƭfinding: <br />2 <br /> <br />
