PlanningandZoningCommissionRegularMeeting <br />April21,2016 <br />SulzerZoneChange <br />applicantseekstohavethesubjectpropertyrezonedfromLL(LargeLot <br />Residential)toLI(LightIndustrial)forthepurposeofconstructingadditionaloffice <br />andshopbuildings.Thereareanumberofphysicalconstraintsassociatedwiththe <br />sitethatwarrantconsiderationfortheproposedrezone.ThelocationoftheF101 <br />drainagechannellocatedalongthesouthpropertylineofthesubjectsiteandthe <br />ExxonPipelineCorridorlocatedadjacentalongthewestpropertylineprovide <br />physicalconstraintsthat,ineffect,limitsaccesstotheparceltodevelopasalarge <br />lotresidentialuse. <br />2.Access.Thesubjecttractoflanddoesnothavefrontageonapublicrightofway. <br />HoweverthereisanaccesseasementacrosstheexistingSulzertracttothenorth <br />thatprovidesprivateaccesstoOldLaPorteRoadandultimatelySensRoad. <br />Becauseofthis,accesstothesitetodevelopasalargelotresidentialusewould <br />beunpractical.Stafffindsthataccesstotheadjacentindustrialparceltothe <br />northwouldbemorereasonable.Additionally,ReserveB,whichisthedetention <br />pondtract,hasanemergencyaccesseasementtothesouththattiesintoN.P <br />Streetandwouldprovideaccesstothesiteintheeventabilitytoaccessthe <br />Sulzercampusfromthenorthwasnotpossible. <br />3.Utilities.Waterandsewerlinesarenotinthevicinityofthesubjectsite, <br />thereforerequiringextensionsofthoselinesinorderforthesitetodevelop <br />residentially.Additionally,therearenorightsofwayorutilityeasementstoget <br />thoseutilitiestothesubjecttractofland.Sincetheapplicanthasdirectaccessto <br />publicwaterandsewertiedtotheexistingSulzercampus,theycouldtieinto <br />theirexistingprivatesystemstoprovidenecessaryutilities. <br />4.Buffer.Theapplicanthasmetwiththesurroundingpropertyownerstodiscuss <br />theirproposalandaddressanyoftheƓĻźŭŷĬƚƩƭconcerns.Theapplicanthas <br />agreedtomaintainReserveB,whichistheexistingdetentionpondasabuffer <br />betweenthesubjecttract(ReserveA)andtheadjacentresidentialdevelopment <br />totheeastofthepond.ThereisnoproposaltorezoneReserveB,andassuchit <br />willremainzonedLL.However,staffisrecommendingthatfurtherconsideration <br />begivenonanappropriatebuffertotheLargeLotzonedpropertytothesouth <br />acrosstheF101drainagechannel.Staffisrecommendingconsiderationofa30 <br />footbufferfromtheedgeoftheHarrisCountyFloodControlDistrictboundary. <br />Additionally,Section106444(a)oftheĭźƷǤƭCodeofOrdinancesoutlinesbuffer <br />requirementsthattheapplicantwillneedtoadheretoaspartoftheir <br />development.Asaresult,theapplicantwillberequiredtoprovidean8foothigh <br />solidwoodormasonryfencetominimizeanypotentialimpacttotheexisting <br />residentialorasolidhedgerowwithshadetrees. <br />5.ComprehensivePlan.TheCityofLaPorteComprehensivePlanoutlinesagoalof <br />maintainingtheLargeLotresidentialdistrict.Onthispremise,asimilarzone <br />changerequestbyQualawashHoldingsLLCfromLLtoLIwasdeniedin2015. <br />3 <br /> <br />
