Planning and Zoning Commission <br />January 19, 2023 SAC #22-25000010 <br />Planning and Development DepartmentStaff Report <br />SAC-#22-25000010 <br />DISCUSSION <br />Location: <br />th <br />The subject right-of-wayis a portion of W. F Street, east of S. 16St. and locatedbetween <br />Lots 16 and 17, Block 827 and Lots 1 and 32, Block 830, Town of La Porte, Harris County, <br />TX. <br />Background Information: <br />Staff received an application to close a portion of the existing W. F Street. As per the new <br />requirements recently approved by the City Council, the Planning and Zoning Commission held <br />a public hearing on December 15, 2022, to consider a recommendation to the City Council. At <br />that meeting, staff presented concerns regarding an existing water main, and the drainage <br />infrastructure located within the proposed closure area. The applicant responded that the water <br />main is not located within the proposed closure area. Staff have since confirmed that the water <br />main was inaccurately depicted in GIS and is not located within the proposed closure area. The <br />Commission expressed additional concerns and questions regarding the proposal. The item was <br />postponed until the January 19, 2023, meeting. <br />channels, drainage systems or roadside ditches should be saved to maintain proper drainage <br />infrastructure. This infrastructure provides the final outfall path for most of the drainage within <br />the area. For this reason, Public Works and the City Engineer do not recommend closure of this <br />right of way. <br />Chapter 62 of the City Code of Ordinances, was recently updated torequire that applicants <br />requesting closure of certain rights-of-way where city infrastructure currently exists, shall pay for <br />the removal and relocation of the infrastructure. Staff has informed the applicant that, as part of <br />the pending closure approval,the City requires a signed statement from the applicant stating <br />that they will relocate the existing drainage infrastructure at their cost. <br />RECOMMENDATION <br />Staff recommends the Planning and Zoning Commission considerthe proposed street and alley <br />closure SAC #22-25000010. <br />ATTACHMENTS <br />Exhibit A:AreaMap <br />Exhibit B:ROW Abandonment Flow Chart <br />Exhibit C:ROW Study <br />8 <br /> <br />
