Staff Report Fence July 28, <br />Variance Requests <br />Requested by : Daun Lambert (Property Owner at 3234 Andricks Road) <br />1 egues ed 'or Lots 1.03 & 104, Block 6; Spenwick Place, Section 1, LaPorte, Harris <br />County, Texas. <br />Location 323$ & 3242 Andricks Road <br />pLin p Low Density Residential (R -1) <br />Background .Applicant is requesting variances, one for each lot described above, to allow <br />construction of a fence on the property line in the front yard setback of the <br />above referenced lots. Upon learning of the erection of a gate with fence, the <br />City Official informed the applicant of the requirements of the current <br />ordinance. The applicant stated that she would comply with the ordinance, if <br />necessary, but she wanted to keep the gate wlfence in place.. <br />The applicant submitted variance requests in order to allow construction of a <br />fence at the property line in the front yard setback. Her in-laws purchased the <br />property at 3238 Andrieks Road (lot 103), which borders with her residence. <br />They have a plan to build a house and would life to join the fi-ont fence <br />together for protection of children. <br />In addition, they have a 25-year term land lease on adjacent lot 104 from the <br />property owners. Copies of land lease and authorization letter are attached <br />herewith. The applicant wants to build a similar front yard fence here to be <br />consistent with her in -law's property. The purpose is to ensure security and <br />safety of the children and property. <br />The applicant has submitted photos of the fence on the neighboring property. <br />The City's Code of Ordinances prohibits a fence placed within the front yard <br />setback in the all zoning districts except large lot residential (greater than 1 <br />acre) and lots directly adjacent to Galveston Bay. <br />Staff analyzed the surrounding area and based upon site inspections and the <br />pictures submitted by the applicant, the following is noted: <br />As seen in the photos, the existing block containing the residence has <br />existing fences in the front yard setback. <br />"The requested fence would be in line with the fence of an abutting <br />property owner.. <br />"I`he front yard fences can also be seen to the cast and south across <br />the street from the subject propcities.. <br />
