<br />REQUEST FOR CITY COUNCIL AGENDA ITEM <br />Appropriation <br />Agenda Date Requested: March 23, 2020 <br /> <br />Requested By: Source of Funds: N/A <br />Steve Deardorff, Chief <br /> <br />Department: <br />Police <br />Account Number: N/A <br /> <br />Amount Budgeted: N/A <br />Report Resolution Ordinance <br /> <br /> <br /> <br />Amount Requested: N/A <br />Exhibits: Public Hearing Notice <br />Budgeted Item: Yes No <br /> <br />Ordinance 2020-3785 Chapter 42-Curfew for <br /> <br />Juveniles <br /> <br />SUMMARY <br />In accordance with Section 370.002 of the Texas Local Government Code, Review of <br />Juvenile Curfew Order of Ordinance, the City of La Porte is required to hold a public <br />hearing concerning its existing juvenile curfew ordinance every third year, beginning <br />with the year of its adoption. <br /> <br />Ordinance 93-1887, which was codified as Article III, in Chapter 42 of the La Porte <br />Code of Ordinances, has been in effect since 1993. Minor amendments were made in <br />2016. <br /> <br />The curfew ordinance prohibits any minor under the age of 18 to be in a public place, <br />including for-profit business establishments, between the hours of 12 Midnight and 6 <br />a.m. on any day of the week, and between the hours of 9 a.m. and 2:30 p.m. on any <br />school day, subject to certain enumerated exceptions and defenses. Over the last four <br />years, the below charges have been filed for violation of this ordinance with the La Porte <br />Municipal Court: <br /> <br />2016 - 78 charges <br />2017 - 64 charges <br />2018 - 71 charges <br />2019 - 39 charges <br /> <br />There are three possible actions that may take place after the public hearing: <br />1. Re-adoption of the Ordinance as written. <br />2. Abolish the Ordinance. <br />3. Modify the Ordinance. <br /> <br />
