The proposed structure would be located approximately 2 miles north of the <br />La Porte Municipal Airport, La Porte, Texas. It would exceed the obstruction <br />standards of Part 77 of the Federal Aviation Regulations, Section 77.23(a)(.2), <br />by 60 feet, a height in excess of 200 feet above ground level within three nautical <br />miles of the La Porte Municipal Airport. <br />The proposal was circularized to all known potentially concerned aviation and <br />nonaeronautical interests by letter on July 25, 1977. There was one response <br />received as a result of the circularization. <br />The Mayor of the City of La Porte objected because he believed the proposed <br />structure would interfere with aircraft landing or departing runway 12 <br />at the La Porte Municipal Airport. <br />The Aeronautical Study of the proposal disclosed the following: <br />The construction of the proposal would not require revision of any <br />existing or planned instrument flight rule (IFR) procedure operation <br />or minimum flight altitude. <br />The proposed structure would be located approximately 1 mile southeast of <br />an existing 420° AGL, 454' AMSL,structure and is of sufficient distance <br />from the La Porte Municipal Airport so as not to interfere with aircraft <br />approaching or departing runway 12 or any other runway on the airport. <br />In addition, the structure would not be on the extended center line of <br />runway 12 since it is due north of the airport and would not interfere <br />with any traffic pattern to the La Porte Municipal Airport. <br />Therefore, based upon the findings of the aeronautical study, the proposed <br />distillation tower would not have a substantial adverse effect upon IFR <br />or VFR aeronautical activity and would not be a hazard to air navigation <br />provided the structure is appropriately marked and lighted in accordance <br />with standard marking and lighting procedures. <br />This determination issued in accordance with FAR Part 77 does not preempt, cancel, <br />alter, supersede, or suspend any ordinances, laws, or regulations of any <br />governmental body or agency. <br />A request for extension of the effective period of this determination should <br />be submitted by the proponent not less than 15 days prior to bhe expiration <br />date. <br />• • <br />
