Should this annexation be completed before <br />the water district can be formed and can issue and deliver its bonds, <br />then this annexation would completely stop and would dissolve the water <br />district. Therefore Nfr. Duncan has requested the City to give him an <br />expression to the effect that the City has no objection to the creation <br />of this district and tha t it does not intend to complete the annexation <br />until the district has been completed and funds have been made available <br />for the construction of water and sewer facilities. <br />Trlhereas the State Statutes provide that wl'ien a city annexes an <br />w entire fresh water supply district or water control and improvement dis- <br />trict, then the City acquires all of the assets of this district and <br />assumes all of the debts of this district. It is the position of the <br />City of La Porte that it is fully justified in asking that the developer <br />agree to the following conditions: <br />(a) It is intended that the Board of Supervi sots of the <br />proposed District will submit to the City of La Porte <br />all plans and specifications for the construction. of <br />j' water and sewer facilities and that these plans and <br />9 specifications meet the City of La Porte standards. <br />(b) That all water and sewer facilities constructed will <br />be so designed that they will be readily integrated <br />with the City of La Porte facilities should they be <br />extended to this area. <br />(c) It is understood that the owners and developers intend <br />to have Mr. Ernest L~ Brawn, ~,, employed as Fiscal <br />Agent for this District and have Mr.Brawn instructed <br />to keep in mind the City of La Porte and its financial <br />position in determining all terms and conditions of the <br />proposed bonds to be sold by the Fresh Water Supply <br />District.. <br />(d) That the District give serious consideration to the <br />possibility of tying the proposed District system <br />into the City of La Porte system, This proposition <br />is a suggestion that these matters be explored and <br />of course if it is determined that this procedure <br />is both feasible and economical then it would be <br />the wishes of the City Commission t':iat it be carried <br />out. <br /> <br />L Subject to the written acceptance of the conditions contained <br />in this resolution the City Commission does hereby assure all interested <br />parties that so long as this development is carried out in a manner <br />consistent with the future demands of the area and acceptable to the <br />City of La Porte, then it is not the intention of the City Commission <br />to annex this area until after the District has been created and <br />monies have been made available for the construction of the water <br />and sewer facilities within the area and assuming that this project <br />will be ca tried through to completion within the normal length of <br />time. <br />r.:~ <br />
