<br />. MINUTES - REGULAR MEETING <br />of the <br />LA PORTE CITY COMMISSION, LA PORT E, TEXAS <br />December 21, 196+ <br />7 :00 PM <br /> <br />MEMBERS OF THE COMMISSION PRESENT: Mayor H. P. Pfeiffer, <br />Commissioners Frank G. Baker, Tom W. Osburn, and <br />Russell Shepherd. <br />MEMBERS OF THE COMMISSION ABSENT: Commissioner W. A. Stabs, Jr. <br />OTHER CITY OFFICIALS PRESENT: City Attorney C. L. Pitman, <br />City Clerk Clovis D. Mann, City Engineer H. Carlos Smith, <br />and Water Superintendent Lyman Cunningham. <br />PRESIDING: Mayor H. P. Pfeiffer. <br />-F -F + <br />1. Minutes of the regular meeting of December 7, 196~I-, and of <br />the special meeting of December 9, 196~I-, were read and <br />approved. <br />+ + + <br />2. Mr. Bert Brandt, 722 S. Blackwell, appeared before the <br />Commission, represented by Attorney Will Sears, in the <br />interest of a request to open a street from Roscoe Avenue <br />to the Bay, which he claims was dedicated as a public <br />street, and therefore should be opened. There is now a <br />fence across the alleged street. <br />City Attorney C. L. Pitman advised the Commission that as <br />of this date, sufficient proof had not been submitted to <br />show that the dedicators owned the land at the time the <br />dedication was filed for record. The City Attorney's <br />opinion was read into the record, and is attached to these <br />minutes. <br />Commissioner Osburn made a motion, seconded by Commissioner <br />Shepherd, that the City Attorney advise the present alleged <br />owners of the land to submit sufficient and adequate proof <br />that they own the land in question, and that there is no <br />dedicated street as claimed; that the evidence be submitted <br />by January 18, 1965; that in the absence of such evidence, <br />action would be forthcoming to cause the removal of the <br />fence.
