• 0 <br />JOINT PARTICIPATION AGREEMENT <br />• THIS AGREEMENT, made and entered into this 5th day of Segtember , 191l—, <br />by and between the City of LaPorte, State of Texas, Party of the First <br />Part, hereinafter referred to as the "CITY," and the United States of <br />America, Party of the Second Part, represented herein by the National Guard <br />Bureau, Departments of the Army and the Air Force, acting by and through <br />the United States Property and Fiscal Officer for the State of Texas, a <br />contracting officer of the United States of America, hereinafter referred <br />to as the "GOVERNMENT". <br />W I T N E S S E T H: <br />WHEREAS, the CITY desires to construct an 8" water main to service <br />both the ANG Facility, The Municipal Airport and various other public users <br />located at La Porte, Texas; and <br />WHEREAS, the GOVERNMENT desires to participate in the anticipated costs <br />of construction of such water main for the purpose of servicing such of <br />its facilities as appropriate. <br />WHEREAS, the CITY is writing to contract for this project and bear the <br />cost of such project to the extent that local funds are available and soon <br />is in a position to fix the extent of its participation herein; and <br />WHEREAS, the initial estimated cost of such project is itemized as <br />follows: 4000 LF of 8" water line. Total cost $30,000. <br />WHEREAS, the initial estimated cost of subject project is $30,000, the <br />GOVERNMENT has agreed to assist the CITY in the amount of $9,000, or <br />• 30 percent of the estimated cost of the project, whichever is less, and <br />the GOVERNMENT has programmed from funds budgeted for the use and adminis- <br />tration of National Guard Bureau an amount not to exceed 30 percent, or <br />$9,000, whichever is less. The CITY has committed $21,000 or approximately <br />70 percent to provide for the remaining costs of the project; and <br />WHEREAS, it is agreed that the GOVERNMENTS share,of participation is <br />limited to construction costs only and excluded such items as engineering <br />costs, including design, advertising, supervision, inspection, soils <br />investigation and all required testing. <br />WHEREAS, the parties desire to reduce their understanding to writing <br />in agreement form setting forth their respective duties and obligations <br />so that the aforesaid project may be accomplished in an orderly and expedi- <br />tious manner; <br />NOW, THEREFORE, IN CONSIDERATION of the mutual promises and agreements <br />herein contained, the parties hereto do hereby agree as follows: <br />THE CITY AGREES: <br />1. That it has coordinated with representatives of the National Guard <br />Bureau for the purpose of establishing the exact design criteria and scope <br />of work to be detailed in plans and specifications. <br />2. That it will at its own cost and expense and independent from its <br />contributions set forth herein forthwith prepare and submit to the National <br />0 <br />
