PUBLIC HEARING TO CONSIDER VARIANCE TO ALLOW DRIVE-IN <br />RESTAURANT - LOTS 21, 22, 23, 24, AND 25, BLOCK 36, TOWN <br />OF LA PORTS - The Mayor asked the City Clerk if certified <br />letters had been mailed to the Residential half of Block 36 <br />and if so, how many letters were mailed: The City Clerk <br />stated that four letters had been mailed by certified mail <br />to the property owners on the Residential half of Block 36. <br />There was no response by the property owners by mail, phone <br />or person. <br />Mayor Meza asked if there was anyone present wishing to <br />object to the rezoning? No one spoke. <br />Motion by Commissioner Kibodeaux, seconded by Commissioner <br />Tomerlin to grant a variance to the Zoning Ordinance and <br />allow a drive-in restaurant on Lots 21, 22, 23, and 24, also <br />25, Block. 36, Town of La Porte, with the following Special <br />Conditions to the Building Permit: <br />A. The trees at the rear of these lots shall not be <br />removed by owners without the prior written consent <br />of the City Commission, so that the trees can serve <br />• as a sound and light barrier. <br />B. Owners shall construct and maintain a solid six foot <br />cedar fence across the rear, property line, and on <br />the side property lines to the 25-foot front setback <br />line. <br />C. No alcoholic beverages shall be sold. <br />D. No outdoor speaker or music, except the individual speakers <br />for communication with the customers in their cars. The <br />volume on these outdoor speakers shall be kept as low as <br />possible, consistent with the nature of the operation. No <br />outdoor music speakers. <br />Motion carried by the following vote: <br />AYES: Commissioners Tomerlin, Kibodeaux, and Simons. <br />NAYS: None. <br />+ + + <br />• <br />
