• • <br />• RESOLUTION NO. 78-01 <br />A RESOLUTION SITPPORTING SENATE BILL NO. 381. <br />WHEREAS, the property along the waterfront is being <br />severely damaged because of the sinking of the land; and <br />WHEREAS, this area is suffering an unnatural phenomenon <br />due to the sinking of the land; and <br />WHEREAS, this phenomenon is not a direct result p~ <br />neglect by the waterfront property owners and they should <br />not lose their property because of the sinking land; and <br />WHEREAS, many owners of waterfront property are denied <br />its use because they cannot reclaim eroded or sinking land <br />• by using bulkheads and filling behind them; and <br />WHEREAS, the enforcement of this law amounts•to confis- <br />cation of property without due process of law; and <br />WHEREAS, Public Law 92-500 will result in unwarranted <br />intrusion by the Federal Government on property owner's rights, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />.CITY OF LA PORTE, TEXAS <br />THAT, the City supports the theory that land erosion and <br />submerging due to subsidence was never intended to come under <br />the laws which deal with nature's ordinary erosion and sub- <br />merging of land; and <br />THAT, the City of La Porte supports Senate Bill 381 <br />which would amend Public Law 92-500 and which would return <br />• to the owner that property which has been damaged due to <br />subsidence and erosion and allow reclamation of same. <br />PASSED AND APPROVED this 9th day of January, 1978. <br />- CITY OF LA PORTE <br />By <br />J.
