• • <br />• <br />-2- <br />III. <br />LA FORTE will, not be liable for loss or damage to person or <br />property arising from or caused by or resulting from alleged <br />negligence of LA FORTE, its officers, employees, or volunteers, <br />in carrying out this contract. PORT agrees to release, and save <br />and hold LA FORTE harmless, from any such claim for loss or damage by <br />itself, or by any person, firm, corporation, or association, in connec- <br />tion with this contract. PORT further agrees to reimburse CITY the <br />fair market value of any of CITY'S equipment damaged or destroyed <br />while engaged in fire suppression services in behalf of PORT hereunder. <br />n <br />U <br />IV. <br />PORT shall provide primary fire suppression service. <br />LA FORTE agrees to provide secondary fire suppression services for <br />real and personal property situated within PORT'S Harbour's Cut <br />Terminal(but not including on-board vessel fires) , for the term <br />of this agreement, upon the terms and conditions herein contained, <br />when, in the judgment of PORT employees, such service is necessary <br />to deal with a specific emergency. <br />V. <br />Sole discretion will rest with the LA FORTE Fire Chief, or <br />his duly authorized assistants, as to the men and equipment that <br />will answer each fire alarm, provided that protection will be <br />adequate (meaning reasonable protection, considering available <br />• men and equipment of LA FORTE'S Fire Department) and sending of <br />men and equipment to protect property within PORT will be sub- <br />• ordinate to requests for, and rendering of, fire protection <br />within LA FORTE. <br />VI. <br />PORT agrees to authorized LA FORTE duly authorized officers <br />the right to inspect property within PORT'S Harbour's Cut Terminal. <br />VII. <br />This agreement has been duly authorized by resolutions of the <br />governing bodies of the parties hereto. <br />• <br />
