<br />• <br />CITY OF LA PORTE <br />INTER-OFFICE MEMORANDUM <br /> <br />• <br />T0: JIM HUDGENS, CITY ADMINISTRATOR <br />FROM: BOARD OF INSPECTION <br />SUBJECT: ORDINANCE NO. 1146 - CASH BONDS <br />DATE: OCTOBER 15, 1979 <br />When Ordinance No. 1146 was passed, April 4, 1979, w~ the Board <br />of Inspection, had requested in Section 8-147 of said Ordinance, <br />a $250.00 cash bond from the owner of the building when they were <br />the contractor. <br />Since the passage of this Ordinance we have found the $250.00 <br />cash bond required of the owner of the building, when they were <br />the contractor, to have caused undue hardships. <br />Therefore, the Board of Inspection is~requesting this requirement <br />of Section 8-147 of Ordinance No. 1146 be deleted. <br />Section 8-147 as revised would read as follows: <br />"AT THE TIME OF MAKING AN APPLICATION FOR A PERMIT <br />UNDER THIS DIVISION, WHERE THE APPLICANT IS THE OWNER <br />AND CONTRACTOR OF THE BUILDING TO BE DEMOLISHED, NO' <br />CASH BOND IS REQUIRED. WHERE THE PERSON MAKING <br />APPLICATION IS A CONTRACTOR AND NOT THE OWNER OF THE <br />BUILDING TO BE DEMOLISHED, A FIVE HUNDRED DOLLAR ($500.00) <br />CASH BOND IS REQUIRED. THE BOND SHALL BE CONDITIONED THAT <br />THE PRINCIPAL, IF GRANTED A PERMIT, WILL ACCOMPLISH SUCH <br />DEMOLITION IN STRICT ACCORDANCE WITH THE TERMS OF THIS <br />ARTICLE, AND WILL PAY TO THE CITY ANY EXPENSE INCURRED BY <br />IT IN ELIMINATING FIRE HA7,ARDS OR OTHER CONDITIONS CREATED <br />BY SUCH DEMOLITION WHICH ARE DETRIMENTAL TO THE PUBLIC <br />WELFARE. SUCH BOND SHALL BE MADE PAYABLE TO THE CITY <br />AND SF3ALL INURE TO THE BENEFIT OF ANY PERSON DAMAGED OR <br />INJURED, IN ANY MANNER, BY THE PRINCIPAL OBLIGOR BY REASON <br />OF SUCH DEMOLITION, EXCEPT THE AGENTS, SERVANTS OR EMPLOYEES <br />OF THE PRINCIPAL OBLIGOR." <br />• <br />
