,. <br />~~~- , y <br />s ~~-- ~ <br />'The Li ht~ <br />compa~iry <br />~„~o~~,~~,,,g~w.~ <br />November 28, 1979 <br />Honorable Mayor <br />City of La Porte <br />La Porte, Texas <br />Gentlemen: <br />and City Council <br />As you are aware, the City Council has not yet <br />completed action on the pending rate application of Houston <br />Lighting & Power Company. The Council has previously taken <br />action to suspend the effective date of the proposed rate <br />increase for a period of one hundred and twenty days. <br />• Under the Public Utility Regulatory Act any regula- <br />tory authority has a maximum period of one hundred and fifty <br />days beyond the proposed effective date of a rate increase in <br />which to complete action on the application. While this <br />statutory time period will not expire prior to January 4, 1980, <br />the one hundred twenty day suspension period for the rate <br />application will expire on December 5, 1979. At this time the <br />Public Utility Commission of Texas has not yet taken final <br />action on HL&P's rate application, which has been designated <br />Docket No. 2676. However, the Examiner's Report was filed <br />November 19, 1979, and a hearing on the Commission's Final <br />Order is scheduled for December 10, 1979. <br />In order to achieve maximum uniformity in rate levels <br />throughout the service area, HL&P is taking steps to put into <br />effect, subject to refund, temporary rates throughout the <br />Company's service area pending final action on the Company's <br />rate application.
