Tanner <br />Washington, D.C. 20530 <br />C7 <br />April 10, 1980 <br />Page 2 <br />The Cities respectfully request special expedited consideration of <br />this submission, for the following reasons: <br />(1) The City of Lomax has been notified that its water and sewer <br />services will be terminated as of July 30, 1980. A copy of <br />the notice of such is attached hereto as Exhibit "B". <br />(2) A time table of the events necessary for a charter amendment <br />election at the next legal election date, August 9, 1980, is <br />attached hereto as Exhibit "C". If the City were unable to <br />accomplish all of the prerequisites for a charter election <br />as shown therein, the next date at which a charter election <br />could be held under Texas law would be January 16, 1981. <br />Our current City charter requires that copies of the new <br />charter be mailed to all voters in the City. Expedited pre- <br />clearance will permit the residents of Lomax to participate <br />in the charter election. <br />The following information is given in compliance with Part 51 of <br />Title 23, Judicial Administration: <br />(1) A copy of Ordinance Number 1193 of the City of La Porte, <br />Texas, which ordinance embodies the proposed changes affecting <br />voting, is attached hereto as Exhibit "D". This ordinance <br />canvasses the election which consummated the consolidation of <br />the cities of La Porte and Lomax. <br />A copy of Ordinance Number 186 of the City of Lomax, Texas, <br />is attached as Exhibit "E", canvassing the election in which <br />the citizens of Lomax expressed their desire for consolidation <br />with La Porte. <br />(2) Under Texas law, the only remaining formality is a certifi- <br />cation by the cities of La Porte and Lomax to the Texas <br />Attorney General of the favorable outcome of the election. <br />The cities anticipate that this certification will be filed <br />to become effective on April 28, 1980, at 12:01 a.m, which time <br />will serve as the mo,nent of consolidation for all purposes. <br />Copies of the certifications by the two mayors are attached <br />hereto as Exhibit "F". <br />(3) This change has been brought about by petition and election of <br />the people of the cities of La Porte and Lomax. The redis- <br />tricting of the combined City of La Porte is a responsibility <br />of the City Commission of the combined City. The districting <br />proposal submitted herein was drawn on April 7, 1980, at a <br />joint meeting of the City Commission and the Charter Revision <br />Committee. Minority members were present at that meeting, <br />participated in discussion and joined in the unanimous vote <br />
