Motion was seconded by <br />Councilman Tomerlin. Motion carried 3-ayes and 0-nays. <br />Ayes: Councilmen Tomerlin, Cline and Simons <br />Nays: None <br />7. Motion was made by Councilman Simons to accept the bid submitted <br />by McKey Construction Co. to construct a 1611 sewer force main to <br />connect the Lomax Addition sewer system to the La Porte system <br />Project No. 12 - 0 . The Motion was seconded by Councilwoman <br />Cline. Motion carried 2-ayes and 1-nay. <br />Ayes: Councilmen Cline and Simons <br />Nays: Councilman Tomerlin <br />8. City Attorney Askins read, AN ORDINANCE OF THE CITY OF LA PORTE, <br />TEXAS, DECLARING CERTAIN RATES FOR GAS AND GAS SERVICE CURRENTLY <br />BEING CHARGED BY ENTEX, INC., TO BE JUST AND REASONABLE; ACCEPTING <br />THE OFFER OF ENTEX NOT TO FILE NEW OR REVISED RESIDENTIAL AND SMALL <br />COMMERCIAL RATE SCHEDULES REQUESTING AN INCREASE LEVEL OF RATES <br />WHICH WILL BECOME EFFECTIVE PRIOR TO APRIL 1, 1983; DETERMINING <br />THAT ENTEX AND AETNA FIRE UNDERWRITTERS INSURANCE COMPANY HAVE <br />INCURRED NO REFUND, CREDIT OR INTEREST OBLIGATIONS UNDER THE BOND <br />PAYABLE TO THE CITY OF LA PORTE; AUTHORIZING THE MAYOR AND CITY <br />ATTORNEY TO TAKE ALL STEPS NECESSARY TO CAUSE THE DISMISSAL OF <br />GAS UTILITIES DOCKET NO. 1175; CONTAINING SEVERABILITY AND RE- <br />PEALING CLAUSES; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; <br />AND PROVIDING AN EFFECTIVE DATE HEREOF. Motion was made b <br />Councilman Simons to adopt Ordinance No. 122 , second by Council- <br />man Tomerlin, motion carried 3ayes and 0-nays. <br />9. (a) Motion was made by Councilman Tomerlin to approve a utility <br />extension agreement, including all costs of labor and installations <br />incurred by the City of La Porte, for Block 436, Lots 14, 15,1 , <br />Town of La Porte, Fred Westergren. The motion was second by <br />Councilman Simons. The motion carried 3-ayes and 0-nays. <br />(b) Motion was made by Councilman Tomerlin to approve a utility <br />extension agreement, including all costs of labor and installations <br />by the City of La Porte for B.W.F. Corp in Block 618, Lots 1-32, <br />Town of La Porte. The motion was second by Councilman Simons. <br />The motion carried 3-ayes and 0-nays. <br />Ayes: Councilmen Tomerlin, Cline, Simons <br />Nays. None <br />10. Motion was made by Councilman Tomerlin to utilize the money budgeted <br />in the 1979-80 Public Works Budget for a tractor trailer, for a <br />more urgently needed capital outlay_, a Pneumatic, rubber tired <br />roller, to aid in street construction. The motion was second <br />by Councilwoman Cline, motion carried 3-ayes and 0-nays. Bids to <br />be received October 22, 1980. <br />• 11.
