r ~ <br />~~ <br />AN ORDINANCE AMENDING SECTION 17(c), ORDINANCE N0. 1221 (EFFEC- <br />TIVE JULY 16, 1980), (NUMBERED AS CHAPTER 12 1/2, SECTION <br />12 1/2-1 OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE), <br />"INDUSTRIAL WASTE"; CONTAINING A SEVERABILITY CLAUSE; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFEC- <br />TIVE DATE HEREOF. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br />July 16, 1980), numbered as Chapter 12 1/2, Section 12 1/2-1, <br />of the Code of Ordinances of the City of La Porte is hereby <br />Section 1. Section 17(c) of Ordinance No. 1221 (effective <br />1~ D <br />ORDINANCE NO.~ <br />amended, to hereafter read as follows, to-wit: <br />• <br />"Section 17. <br />Industrial Cost Recovery Surcharge . <br />"(c) The discharger of the wastes enters into a contrac- <br />tural agreement with the City of La Porte providing <br />for a surcharge over and above the existing sewer <br />rates. The basis for surcharge on industrial wastes <br />is to be computed on the following basis: <br />ISS = ( BOD + SS ) X (O & M Cost) X (Vol); where <br />250 300 <br />(1)ISS represents Industrial Waste Surcharge in <br />Dollars; <br />(2)BOD represents the Biochemical Oxygen Demand <br />(mg/1) of the Industrial Waste as determined under <br />standard laboratory conditions for a period of <br />5 days at 20° C. Note: for concentrations less <br />than or equal to 250 mg/1 the value of BOD shall <br />be considered 0; <br />(3)SS represents Suspended Solids of the Industrial <br />Waste (mg/1). Note: For concentrations less <br />than or equal to 300 mg/1 the value of SS shall <br />be considered zero; <br /> <br />(4)0 & M Cost represents Operations and Maintenance <br />Cost of La Porte's P7astewater Treatment Facil- <br />ity(s). Note: The operations and maintenance <br />cost as determined by the City of La Porte shall <br />be periodically updated and defined by companion <br />ordinances which concurrently establish water and <br />sewer rates. <br />(5)Vol represents Volume Discharged in Thousand <br />Gallons. <br />The volume of wastes may be determined by the same methods <br />used to calculate the regular sewer service charge. For <br />establishments discharging less tYian 20,000 gallons/day, <br />the BOD and suspended solids values may be determined from <br />standard values for various industries established by the <br />Approving Authority.
