Requires a b <br />of affidavit does not <br />the detectors. <br /> <br /> <br />FIRE PREVENTION <br />CITY OF LA PORTE <br />INTER-OFFICE MEMORANDUM <br />June 29, 1983 <br />T0: Jack Owen, City Manager <br />FROM: Paul Hickenbottom, Fire Marshal <br />David Paulissen, Building Official <br />SUBJECT: Smoke Detector Ordinance <br />r~ <br />This memo is in regards to Ordinance ;1093-A (Smoke Detectors). <br />We would like to submit the following information and proposed <br />ordinance revisions for your review and consideration. <br />The City Council adopted Ordinance ~~1093 on September 13, 1977, <br />and on March 19, 1980 the Ordinance was revised to its present <br />format. <br />This Ordinance is being jointly enforced by the Fire Marshal's <br />office and the Code Enforcement Division. This Ordinance has <br />also been credited with saving several lives since it was adopted <br />in 1977. <br />This Ordinance, as in the'case of many other Ordinances after <br />they have been enforced for several years, is, in our opinion, <br />in need of some revisions because of the following: <br />The Ordinance in its present format: <br />1. Does not clearly define who is responsible for the <br />testing, maintenance or replacement of smoke detectors installed <br />to satisfy the requirements of this Ordinance. Areas of respon- <br />sibility have been an unwritten policy in the past, and have <br />created some problems in regards to the enforcement of this "= <br />Ordinance. <br />2. Does not take into account any area that the City of <br />La Porte may annex in the future which may have existing dwellings <br />or dwelling units which would come under the guidelines of this <br />Ordinance. <br />which have present time tables for the <br />original Ordinance.
