<br />s <br />• <br />• <br />-2- <br />for the purposes herein expressed, City agrees to issue to Kay Homes, <br />upon the request of Kay Homes or its agents, residential building <br />permits for the construction of single family residences, on the <br />remaining two hundred fifty-two (252) platted lots in Brookglen, <br />Section III, a subdivision in Harris County, Texas. ~At the time of ~~~? <br />application for building permits, the Capital Cost Recovery Fee pro- <br />vided for herein shall be considered paid by Kay Homes. However, <br />Kay Homes will remain liable for City's other building permit~..issuance <br />fees and expenses, as follows, to-wit: <br />• (1) City's standard building permit fee, based <br />on valuation of construction, as set forth <br />on Schedule K, City of La Porte's Standard <br />Building Code; <br />(2) Kay Homes' subcontractors shall be liable <br />for the City of La Porte's usual fee for <br />issuance of permits for mechanical, electrical, <br />and plumbing; <br />(3) In lieu of any other applicable water and <br />sewer connection and tap fees, Kay Homes <br />shall be required to pay the sum of Forty <br />Four Dollars ($44.00) on each building permit . <br />to reimburse City for the water meter and <br />the water meter box, and an inspection fee <br />of Five~Dollars ($5.00) on the sewer tap. <br />Kay Homes shall not be required to pay any other applicable water <br />and sewer connection and tap fees under City of La Porte Ordinances. <br />Kay Homes shall install the water and sewer taps in accordance with <br />City specifications. City shall install the water meter and water <br />• meter box. <br />3. In the event of any moratorium order by a state or federal <br />agency having jurisdiction over the City's operation of sanitary <br />sewer treatment facilities for Brookglen, Section III, which would <br />prevent Kay Homes from being issued a, building permit by the City <br />of La Porte, City agrees to reimburse Kay Homes,.upon its written <br />request, the sum of One Thousand Dollars ($1,000.00) per lot, for <br />• which building permits cannot be issued because of the existence <br />of such moratorium or other order by such state or federal regulatory <br />~, <br />G~ <br />
