During our recent meeting in your <br />office, and more recently at a workshop session with BAYMUD, they have <br />expressed the intention of sending a letter of request to you. They have <br />also expressed uncertainty relative to which entity would actually be <br />purchasing the water--Lakeland Group, BAYMUD, or the Property Owners <br />Association for the tract. Since this is unclear and can be determined <br />at a later date, we are writing to request the City's approval for the <br />sale of water for~this purpose subject to negotiations to resolve such <br />open issues. <br />BAYMUD has expressed deep reservations relative to their ability to <br />issue a commitment if they are to rely on LaPorte for their source <br />of additional water. Their primary stated concern relates to one state- <br />ment made by you in our recent meeting. Specifically, that water may <br />not be available if other needs develop within the City limits. You <br />did not clarify if this meant water could be cut off from future develop- <br />ment, from existing users, or only in an emergency. In addition, even <br />though you made it clear that LaPorte had the capacity to serve our <br />entire project, they have expressed concern that the Subsidence District <br />will cut your well permits, thus causing the inability of BAYMUD to <br />service our tract. <br /> <br />
